Is this rape?

Scenario : A husband gets blackout drunk one night. Wife claims he raped her while they were going to bed, he has no recollection. Wife wasn't drinking. She claims she didnt fight it or say no because she felt like she had to. Then she doesn't speak to him for awhile and tells him why. He writes her a letter apologizing, even though he doesn't remember, for ruining her life.


Now imagine the scene involving a sober husband, who is accused of raping his wife while HE is asleep, and she is awake. She doean't fight back, say no, or try to wake him up.

Are either of these instances considered rape?

I wouldn't consider it rape if the wife never said no.

Neither woman ever said no or stop. It's not like they were strangers. They are married couples.

And, if a man has takes advantage of/has sex with a woman too drunk to say no is rape, and he was blackout drunk, couldn't the argument be made that she raped him?

If she didn't say no how the heck is he supposed to know she is unwilling? How is that rape? I am missing something...
