Obama‚Äôs Cancellation ‚ÄúFix‚ÄĚ Violates Law for a Short-Term Public Relations Move

President Obama has told Obamacare‚Äôs critics that the law is ‚Äúsettled‚ÄĚ and ‚Äúhere to stay.‚ÄĚ But today he is saying he‚Äôll violate the law to put a Band-Aid on it for another year. That‚Äôs in addition to the one-year delay in the employer mandate and numerous other ‚Äúfixes‚ÄĚ and delays.
The President is announcing his ‚Äúfix‚ÄĚ to the problem of millions of cancelled policies: According to press reports, the President‚Äôs ‚Äúplan would allow people to keep their plans into 2014,‚ÄĚ by allowing the sale of insurance plans that don‚Äôt meet the law‚Äôs new requirements.
There‚Äôs one problem‚ÄĒthe President‚Äôs promise that his new ‚Äúplan‚ÄĚ can allow people to keep their plans is just as flawed and false as his original ‚Äúlike your plan/keep it‚ÄĚ pledge. The law itself is clear: Obamacare‚Äôs new benefit mandates‚ÄĒthe requirement to cover all individuals with pre-existing conditions, the new ‚Äúessential benefits,‚ÄĚ and mandates increasing the percentage of health costs insurance plans must cover‚ÄĒall take effect on January 1, 2014.
