I have a huge problem and I need some help trying to figure out every legal way to handle it. We had to move a few months ago due to financial reasons which put us in a 'low' income county. Thank God, Cory's old school continued to pick him up so he could finish out the school year there. I love them!! Anyway........the new district school has nothing that Cory needs......and are fighting me on the fact that he needs an aide. I have a caseworker through the MRDD who is awesome, but even she hates the school district and is trying to find everything she can to find out how we can get Cory back into his old school because she is also afraid he will just fall back even farther if he has to go to this school. We cannot afford to move back into the old district, I wish we could because I would do it in a heartbeat!! Anyway- I need to find out if there are any laws that state if you feel your child will not progress at this school that it is in his best interest to keep him at his old school or are there any grants that could help pay for him to go to his old school? Please, I am desperate and need your help!!
Gotta love the school districts (said with sarcasm). They will always fight to do the least amount possible. The law states that they do not have to give your child the best but only what is adaquate. Which to them means almost nothing. I would have your caseworker tell them that he needs an aide. I know that in my state if they cannot provide for your child then they have to pay to send them elseware or for them to attend a private school. I would also try to find an advocate in your state to go with you when you talk to the school. They will know more about the laws in your state and be able to help you in dealing with the school district.
