Step-parent adoption

My husband has complete parental rights of our daughter. The biological mother signed away all of her rights nearly a year ago. I am in the process of getting step-parent adoption and one thing has not been clear to me. After the adoption is finalized, can I change the name on the birth certificate to mine and take the BM off? Thanks! -Ash

It depends on what state you are in.  I can only speak for Iowa - when an adoption takes place, you get a new birth certificate with the adoptive parents' names on it - I see no difference between our kids' and my nephews' who were never adopted. 


Also, in Iowa, there is no such thing as a legal open adoption - it is 100% at the adoptive parents' discretion.

When my husband adopted my 3 , we were issued new birth certificates listing him as he father..So at least here in Ga the answer is Yes.
