The Tusseys had just finished dinner at an Ashland restaurant. Gary stayed inside to pay the bill while Brandy took their two children to the car. Police say Brandy was putting their infant into a child safety seat in the back and Addison had climbed into the front seat.

"While the mother was tending to the infant, she heard a 'pop' and looked up and saw her daughter slumped over the passenger seat," Major Todd Kelley said in a press release Sunday night.

Kelley said Addison found a small caliber handgun fired a fatal shot, into her left cheek.

Addison was taken to Kings Daughters Medical Center and later to a trauma center in Huntington. She died at approximately 8:45 p.m.

Police say the gun had been put in a front console of the vehicle on a previous occasion.

Police will submit their investigation to the Commonwealth Attorney for review. Based on facts and evidence, the final decision on whether charges will be filled will come from the Commonwealth Attorney. At this time, APD says their focus is to ensure the family has a support system in place to deal with the accident.

The Ashland Police Department is continuing to investigate what they call a "tragic accident".

UPDATE 5/21/11 @ 10:47 p.m.
ASHLAND, Ky. (WSAZ) -- A child died following an accidental gun shot wound outside of an Ashland restaurant Saturday night.

Major Todd Kelley of the Ashland Police Department says the child was shot while sitting in a car outside of Cheddar's.

Police responded to multiple 911 calls reporting a child had been hit by a car around 5:45 p.m. When first responders arrived on scene and began to treat the child it became apparent the 2-year-old had been shot in the face.

Police say the child was taken to Kings Daughters hospital and then air-lifted to Cabell Huntington Hospital and died just three hours after the initial emergency calls.

Major Kelley says no one else is in danger and that his department is investigating the death as an accidental shooting.

According to a press release issued by the APD, a parent was putting another child into a car seat when they heard the shot and saw the 2-year-old bleeding in the passenger's seat. The child got the loaded gun out of a center console in the car.

So sad. This is why we don't keep guns in our home. DH hunts with his father and grandfather, but his rifle is stored elsewhere.

That is soo sad, I don't even let my kids in the front seat at all. I certainly don't keep a loaded gun in the car. :( poor baby.
