Parents to sue after five-year-olds touched and kissed each other with teacher in classroom for FOUR months

Parents of two pupils are suing New York City after they claim five-year-olds in a kindergarten class took their clothes off and engaged in sex acts under their desks while the teacher was in the classroom.
The activity is said to have taken place at the elementary school in Amsterdam Avenue, Washington Heights, for four months without parents being informed.
Four to seven children were said to have been showing their body parts to each other and kissing and touching as the teacher had her back turned.

One mother told the New York Post: 'They were exposing themselves and showing their body parts to each other. From what I understand, they were kissing and touching.
'They were trying to say that my daughter was inviting these children to do this to her.
'They [the school] explained the teacher had her back to the children, that it wasn't that long. She must have had her back turned for a very long time for them to do the things that they did.'
The woman has since removed her daughter and transferred her to another school in New Jersey, the Post reported.
Last week, she and the mother of a boy in the class filed notices of claim against the city each seeking $5million in damages. Notices of claim are required before a lawsuit can be filed.
The notices allege the activity by four to seven children took place from September until January.
The mother of the boy reported it to the school after hearing about what was taking place in October.
A report of the complaint was made by the school on December 21, but it did not notify the NYPD or school superintendent and informed parents of other children on January 3, several months after the alleged activity began.
Principal Theresa Luger and the DOE declined to comment.

Is naked hanky-panky in a kindergarten classroom among five-year-olds just normal curiosity -- or an example of negligent teachers?
Two kindergarten parents at PS 189 in Washington Heights think they know. They claim a group of five-year-olds took their clothes off, and were exploring their private parts, even engaging in what appeared to be oral sex while a teacher was in the classroom.
This naked hanky-panky continued from September until January -- according to their lawyer -- even though the parents complained to the teacher and principal.
One of the mothers saying: "they were exposing themselves and showing their body parts to each other. They were kissing and touching. The teacher had her back to the children. She must have had her back turned away for a very long time for them to do the things that they did."
But educator Dulaina Almonte says, "...you have one teacher and 14 students. You can't see everything that goes on."
PS 189 is considered a strong school in the neighborhood, getting an "A" rating from the Department of Education. But, two of the parents don't agree and are exploring a possible lawsuit for $5 million.
"I think that's a little steep," Bianca Garcia, a mother in the Washington Heights neighborhood said. "They probably just want the money and publicity."
And one father and grandfather at the school says if five-year-olds are engaging in what looks like oral sex, It's not the school's fault.
"It all comes from the family," Christopher Parashakis said. "What kids see at home, what are the parents doing? What are they letting their children see on TV?"
A spokeswoman for the
New York City Department of Education says they never comment on pending litigation. One parent whose daughter was involved has transferred her out of the school and out of the state.
