Utah mom in trouble for allegedly taking nude pics of teen daughter
A Roosevelt mother is facing criminal charges after police say she helped her 13-year-old daughter take nude photos to send to an Oregon man because the teen did not know how to work her new iPhone.
According to documents filed in 8th District Court, the 35-year-old woman took three photos of her daughter in the bathroom knowing they would be sent to 30-year-old Daniel Dean Divine.
The teen "realized Daniel was older and wanted to have sex so she took the photos just to keep him happy," a Duchesne County sheriff’s deputy wrote as he sought an arrest warrant for Divine earlier this month. The girl "asked her mother to take the photos of her when she could not figure out how to make the camera on the iPhone work."
The mother, who The Tribune is not identifying to protect the child’s identity, told police she asked her daughter "if she was sure she wanted to send these photos," the document states.
Divine is in custody in a Deschutes County, Ore., jail, awaiting extradition to Utah.
Police say the man sent the girl the iPhone and a camera, which already had on it photos of the man, shirtless and holding a teddy bear the girl had once given him as a Valentine’s Day gift.
The girl’s mother told police Divine was a "very good friend of the family" and that he and her daughter "were going to wait until she was 18 years old before they had a sexual relationship," court documents state.
The mother faces three counts of sexual exploitation of a child, all second-degree felonies. An arraignment is scheduled for August.
No court date has been set for Divine, who also faces three sexual exploitation counts, in addition to a misdemeanor charge of enticing a minor over the Internet.
