Most states will require a court application to be done in order to make the change, and you will probably have to make some effort to locate her BF to get his permission, and then sign an affidavit for the court stating you were unable to find him. If you are just moving to another state, I would wait until you get settled and then see about applying for the name change in your then county of residence. I wouldn't start it where you are now because it could take a few months for the process to play out. Has your husband considered adopting her legally instead?
