Need advice

I have and 8 year old DD who has my maiden last name and me and my husband who have been married 6 years would like to give her our last name and she wants this as well to be the same as her siblings..her BD has not been around he maybe seen her a Hand full of times..and is not in the birth certificate so how how will it be to get it changed..

I believe you will have to change it through the courts in your area. You will need to contact your local government because every state is different.

I think all you would have to do is go to the court house and change it.They might require her dad to sign a permission slip though.

See that's the thing I have no idea where he is and iv lived in another state then him for about 4 1/2 years now and we are about to move with the army

Most states will require a court application to be done in order to make the change, and you will probably have to make some effort to locate her BF to get his permission, and then sign an affidavit for the court stating you were unable to find him.  If you are just moving to another state, I would wait until you get settled and then see about applying for the name change in your then county of residence.  I wouldn't start it where you are now because it could take a few months for the process to play out.  Has your husband considered adopting her legally instead?

Every state has different requirements. You'll have to contact your local government to see if you need the father's permission.

Is he on the birth certificate? If not, I'm sure that will make changing her name easier.

We have talked about the adoption process I guess we just need to get more info on that as well..

He is not on the birth certificate..I was 17 when I had her and he was 22 he wanted nothing to do with her

Have you tried contacting you local courts yet? What state do you live in?

I live in IL but will be moving soon to a new duty station once my husband gets home with training
