We moved into a 3 bdrm in February of last yr, under the condition as soon as a bigger place became available we were next in line for it..A 4 bedroom is coming open this week so we went to talk to him about it..He said he was not going to allow us to move into the 4 bedroom because we have to much clutter? What? There are 6 of us in a 3 bdrm..My oldest has a room to herself, my two middle kids share a room and the baby is still in our room. Of course we have clutter!! We have 3 toddlers and a tween not to mention 2 adults..He said he didnt want to move us in to it until we could prove to him we can downsize and keep it that way..WHAT? My house is not dirty by any means and he even said he didnt have a problem with how I kept house however he didnt agree with the amount of stuff we have..6 ppl in a 989 sq ft home of course there isnt going to be room for everything. Thats why we need the space!!
I agree about sending a certified letter stating that you were promised a bigger place. It sounds like he's giving the bigger apartment to someone else because he can. I would look for a new place because your current one isn't big enough and your landlord clearly won't give you a bigger place.

You don't need to give 30 day notice if your lease ends Feb 18th, the lease doesn't automatically go into month-to-month, and you haven't signed a new lease. Your contract ends Feb 18th. You can just leave.

I was in your same shoes about 18 months ago. I had a really pleasent mean, that is the word I should use, land lords. And from about the time that we were six months into our lease, they would begin to hint that our place was a bit too cluttered. We had a young girl who came to help me clean, and I still had a few boxes that would come at times, to deliver medical equipment or furniture. And it would sit in a particular area of the house until I had time to get to it. But cluttered it was not. My other half is in a motorized wheelchair full time, and to get around we could never have a clutter. So as we go to move to a larger home: the rumor begins to follow us. We grabbed the camera and took pictures of everything, We did not pick up a dirty sock on the floor, we wanted the new land lords to know we were pushed into a corner, There was an overload of furniture for the living room, and the house came furnished. There was furnitrue that had no place to go, and did not fit in. So when the pictures showed what our cleaning was like, and how we worked with what we had, it worked in our favor. I personally *as a homecleaner for hire* believe that clutter is something that is judged by a persons own desire for what they would like a house to look like. Good Luck!
