Car seat laws and the ADA

Does the ADA trump car seat laws? Say your child is 3 and 35 lbs, and is PPD or Autistic and doesn't like car seats. The dr says, ehh just stick them in a seat belt. But state law says 4 and 40 to move to a booster. Does their disability negate the law of riding in a car seat?

I would think state law would over rule. I understand the child may not like the car seat and may fight it, but there's a reason those laws are in place. It's to protect them weather they understand or not.

Many people say ADA overrules laws. I'm just trying to get a clear answer.

Infants hate car seats. Too bad, they sit in them and scream.

My youngest LOVES the car seat. But I'm talking older kids. Sensory issue kids or autistic kids.

where i live they must be in a harnessed carseat until 40lbs. but we don't have any booster seat laws... the law is the law.

I know but because a baby or child is uncomfortable should not trump the law.

So I can have a note from the dr saying my child can ride without a belt and that supersedes the law?

it needs to state the reason, and speak to your attorney to make sure it's all within the guidelines to hold up in court
