OKay my husband and I are in a dilemma. . .Our neighbor moved out about a month ago and had a lot of stuff to give us since he didn't want to take it all.  He was taking his first trip to the new state, and we didn't have room for all the stuff yet, so my husband asked if we could wait until he returns.  He said sure.  Well little did we know that his plan was to leave, skip out on everything and let his home forclose (or so it seems).  Everything has been cut off, and people are even calling us because it seems he gave our name and number to them.

So we thought we'd just check to see if his door was unlocked and noticed the back window is left unlocked.  My husband mentioned using it to go in and get the things he was giving us since his phone has also been disconnected just two days after they spoke about it on the phone.  Anyway. . .he's moving because of a divorce, and I called the soon-to-be ex wife to ask if it would be okay to go ahead and get the stuff.  She has nothing to do with the house anymore and signed it over when the husband told her that WE (hubby and I) have power of attorney and will be leasing or selling as we wish.  WHAT?!?!  We've also sent him a couple of emails asking if it's okay to go in and get the stuff but with no response.

So our dilemma is.  .would it be wrong to go in and get it before the bank seizes the house?  I don't want to feel like I'm "breaking in" but at the same time. . .well you see where I'm going.  Honestly, what do you ladies think?

I have a good friend who does "inspections" for banks that are foreclosing, etc., and he tells me all the time what an awful mess people leave their homes in when they skip out like that.  The bank does not want the stuff inside.  They clear it out and dump it.  I would not see any problem with getting it as long as you don't have to break in to retrieve the items.  My friend also cleans homes out like this that have been foreclosed on, makes repairs, etc.   He said the less stuff in it the easier his job is - obviously. 

The thing I wonder about is why did he put and you and your husband on the spot like that by giving out your name and number and telling his ex that you would have power of attorney.  Not a very good friend in my opinion.

Pray about it. But I also think if you are having a dilemma with doing it then you shouldn't. If someone sees you going through a window to get in to the house, they might call the police (I would if I saw someone doing that).

I wouldn't!  We had a neighbor die, before she died she had talked to another neighbor and wrote a note saying she could have certain things and take care of her daughter.  Someone saw this lady coming in and out of the house (after her death) with various items and called the police.  She went to jail!!  They eventually dropped the charges but, she went to jail!!  Not worth it in my opinion!!

We actually weren't that close.  I mean we were neighbors and helped each other out with little things.  He and my husband had started getting closer when he went through stuff with his wife, but that was still pretty recent.  It was weird.  . . definitely weird.

Maybe watch for the inspector from the bank to come out - because they WILL come.  Trust me!  And they WILL break in if they have to, and ask them.  It sounds like the "stuff" is something you really need and can't afford for yourselves?  If so, that is what I would do.  If it is just cool stuff, then I would probably do without, until you see it unloaded to the curb and then  you could grab it?  I agree that it is a very strange situation.

If the house is in foreclosure it is the banks property and if you get caught breaking into it you will go to jail. Everything in the house whether promised to you or not is the banks property now. I wouldn't do it, It's illegal.

It's not yet.  That's why we wanted to go ahead.

I hope this post isn't too late...

LEAVE THE STUFF THERE!  DO NOT GO NEAR THE HOUSE!!  REMOVE YOURSELVES FROM THE SITUATION, AND AVOID THE HOUSE AT ALL COSTS!!!  THIS CAN ONLY GET WORSE, AND IT'S A HEADACHE THAT YOU DON'T WANT TO HAVE!!!!

I would check to see if you do have power of attorney. If so, see what you can do with it.

We just found out that he placed us as ones who can access his storage building from the storage place too. . . so strange.  We are able to get the things that were given to us and will be doing so this week.  It's such a weird thing.  What's bad is that I think he was just hired into some type of ministry position in Lousiana.  I hate knowing that someone who would do this would be interested or even accepted into a position like that.  We will just continue to pray for him and his family.
