You do not have to have an agent, but some places only accept submissions from a writer that has one. Then again, some agents will not accept a client who is not published, so it's a total Catch 22!
As far as taking steps to getting published you must first research your options. Where will your work be most fitting? Most publishers have a certain kind of writing that they are geared towards. When you have decided on your list of publishers make sure you read and follow their guidelines. Some publishers will only accept inquiries while others want to see sample chapters, etc. I highly recommend the current addition of Writer's Market book.
Anything you write is supposedly "copyrighted", but if you were ever to get into a legal battle about authenticity then an official copyright would be to your advantage. All you would have to do is send yourself a mailed copy of your work, but do not open it! That is the cheap, but legal way to do it! Or you can fill out the proper forms and send a registration fee.

Aimee, I highly recommend the Writer's Market book. Check out your library to see if they have it or can get it. The current year is your best bet because information is constantly changing. This will give you a starting place to match your genre with a publisher/agent and then you can further research your choices. What is your book about? Good luck!
