SPRINGFIELD, GA (WTOC) - Baby Aiden's father is desperate to get out of jail, but the judge insists that's where he belongs.
Today Phillip Waller went back to court and asked the judge to set bond. He is charged with cruelty to a child. This was his fourth attempt at getting a bond set since going to jail in January.
Waller's father, Ernest Waller was also there this time. He told the judge that he would give Phillip a job and place to live if he was released on bond. Prosecutors pointed out Ernest just got out of jail himself after being convicted of beating up his girlfriend. The judge denied bond.
Aiden's mother, Tina Richards, is charged with abusing Aiden and is already serving 21 years for another child abuse charge. Prosecutors say Phillip Waller knew about the abuse but didn't report it. Both Waller and Richards are still awaiting trial on the new charges. No trial date has been set yet.
Aiden, now 13 months old, and his newborn brother remain in the state's custody.

by ALiLBabyPHAT18 on May. 11, 2008 at 3:53 PMJust 2 more days...I am VERY anxious to see if THEY will ADMITT to their charges, especially Tina, being as how they both plead "not guilty"...I was told that they may have only plead their innocents JUST because they wanted a jury trial, instead of having to be sentenced by that judge (hoping for a lesser sentencing)! I guess we'll all have to just wait & see! |

Even though they plead "not guilty", how could a mother and a father allower something like this to happen. They had to know what was going on if they weren't the oned to inflict the injuries. And in my opinion they DID it. I am just sick to my stomach over this, I couldn't imangine seeing any child going through what baby Aiden has had to go through. Tina Richards and her bf made a huge mistake by choosing to go to trial, they jury is going to be harder on them then the judge would have been , because now they have 12 people to convince and really look at the evidence duh. And I bet some of the people that will be on the jury have childern, grand children, nieces, nephews... They will not get a lesser penelty for what they did, they should be given the death penelty, with death be firing squad

I am watching the news right now...as soon as I hear something, I will let ya'll know! I will post the actual news broadcast in a few hours, after it becomes available on-line! Hoping we will know their trial date soon!

The only information that I have found is on Savannahnow.com, where Phillip was denied bond again. That is confusing to me, how many times does he get to request for bond? His dad wanted to take responsibility of him, but the district attorney was against it, because of past and previous trouble that he has got into. Phillips dad does have a jury trial on 06/24/08, I guess for the battery charge, but it also said for attempt of court.

Ok...NOW, I'm confused! It was my understanding that TODAY, Tina & Phillip were having their PLEA HEARING, I even confirmed that with WTOC! Well, I watched the news...NOTHING! So, I went to www.savannahmorningnews.com and I DID find this:
SPRINGFIELD — Bond has been denied a second time for the Guyton father accused, along with his live-in girlfriend, in the abuse of his infant son. Phillip Wesley Waller, 20, appeared Tuesday in Effingham County Superior Court, along with his attorney Stephen Yekel, again pleading for Judge F. Gates Peed to release him on bond, this time to the custody of his father. Ernest Waller, a self-employed painter from Garden City, testified he could provide residence and work for his son. Under cross questioning, Assistant District Attorney Michael Muldrew probed Ernest Waller on his living conditions and past convictions, most recently on battery. “Judge, it’s the state’s opinion that Mr. Waller cannot provide a conducive living environment for his son,” Muldrew said. “In fact, I can’t think of a worst character witness in this particular case than Mr. Waller.” Phillip Waller will be remanded back to the Screven County Jail, where he has been since the week of his arrest Jan. 28 on charges that he knew his 19-year-old girlfriend, Tina Marie Richards, had been abusing the 10-month-old son the couple had together. Richards is more than two months into her 21-year sentence at a women’s correctional facility in Atlanta, where she was sentenced Feb. 28 for violating the terms and conditions of an earlier probation. In that case, she had pleaded guilty to one count of battery and one count of cruelty to a child in the first degree and was placed on first-offender status. The couple’s son, who is now a year old, has been released from Memorial University Medical Center and has been placed into the state’s care. I am going to e-mail Michelle Paytner, since she's the one who always covers Baby Aiden on WTOC, which is SUPPOSED to be the #1 news resource to get info. about his case...I'll get back to ya'll! |

So they put his hearing off. Well he gets to set in jail a while longer, I just can't believe he could sit back and let this happen. Who knows, He may have had a hand in it also. Do we really know he didn't? Even if he didn't he is just as guilty if he did nothing about it.
And his dad just got out of jail for beating his girlfriend. I just can't believe this. I just went through this with two of my daughters this past weekend. It is in a post on page. I have agonized over this for days. These are some real men I tell you. |

I know whatcha mean! I am SOOO glad that me & Phillip broke up years ago...I would HATE to know that I would be stuck with someone like HIM! I thought I KNEW him, but apparently not! God knows what he's doing...but unfortunately Aiden had to suffer because of it! But I know he has a purpose...

God what an awful thing. Who is capable of doing that to a child? There is no need for this man to get bail. He's right where he belongs.
