A year ago I had a full hysterectomy. For many years I had severe endometriosis with hemorrhagic cysts. I was always in a lot of pain.
The surgeon who preformed the procedure never asked me for my medical records. I was in a lot of pain at the time and I explained my history to him. All he did was give me an ultrasound. I agreed to the surgery because I was in pain at the time and couldn't take it anymore. Now, a year later, I am still experiencing some pain in my lower abdomen. Granted it is not nearly is bad. But is still one of the pains I had before the hyst. On top of that the last year has been very difficult with mood swings. I feel like a part of me is gone. I feel like the place where my babies grew was thrown into the trash, if that makes any sense. I feel ugly, and that I have no gender.
My question is that should have the doctor have had my previous medical records to preform a hyst.? I feel like he never went over the side effects of the surgery with me. I have to take hormone replacements and other meds to keep me somewhat sane. Everyday I think about it and wonder what if. On the other hand I am very happy and feel blessed that I was able to have two children. I did sign papers to have the surgery done, out of pain and anguish, but he never went into the side effects of a hyst. I asked him repeatedly if he wanted my previous medical records. Or if I should have another laparoscopy before the hyst. He told me that I needed a hyst. and a laparoscopy would be unnecessary.
Not that I would or even could bring this up in court or anything like that. I just would like to know if what he did was legal. As I said, I did sign for the surgery.
It doesn't SOUND like he did anything illegal, but you should consult an attorney to find out for sure.
