Can someone clarify this for me? Military wives especially.

 DH just faxed me a POA today. There's a specific too but I'm not sure if any of the vehicles listed (by make model color and year, no VIN numbers) will work out.

But as far as the general POA there's some clauses on it that I don't understand fully.

1. To lease, sell, use, establish title to, register, insure, transfer, mortgage, maintain, manage, pledge, exchange or otherwise dispose of or encumber any and all of my property, real, personal, or mixed, including motor vehicles of any kind, and to execute and deliver good and sufficient deeds or other instruments for the lease, conveyance, mortgage, maintainence, or transfer of the same.

2. To buy, recieve, lease, or accept or otherwise acquire in my name and for my account, property, real, personal, or mixed upon such terms, considerations, and conditions as my said attorney-in-fact shall deem appropriate.

and this clause. This is the one I really am lost on.

Fiduciary Powers: My attorney shall have no rights or powers hereunder with respect to any act, power, duty, right or obligation, relating to any person, matter, transaction, or property, owned by me or in my custody as a trustee, custodian, personal representative or other fiduciary capacity for someone else.

I'm not good with legal things and want to make sure I know what I can and can't do. These are the ones I have queestions about. Mainly definitions and limitations.

umm im pretty sure that this means you can sign buy or everything else for your husband but that you don't have rights to do it for anyone else....i dunno i have a friend whose husband is in legal here in base and my husband will be home in a while i could have him look at it..he should be getting off in like 30 minutes so give me an hour.

Thanks. I'm good at inter[reting things usually but I have to buy a car and want to make sure I can if the ones on the specific don;t work out or are too expensive.

I will ask my hubby when he gets home. (He was referred to by a PP Prego) lol If he doesn't know something he always directs people to Legal Assistance. There is one on every base and they will explain the contract or in this case POA in laymans terms. GL and He should be home within the next hr-hr and a half.

bump. Sorry your guess is as good as mine. Why do they have to use such proper wording. lol! why cant it just be you can't do this __ but you can do this __. DH didn't give me a POA because, well I didn't need one!

LOL It seems like everything MUST be complicated. *sigh* and it's taken three months just to get this far.

THE FIRST TWO JUST TELL YOU WHAT YOU ARE ALLOWED TO HANDLE. THE LAST PARAGRAPH I SAYING THAT SAY HE WAS LEFT AS A BENIFICIARY TO HIS PARENTS ESTATE, OR WAS TRUSTEE ON AN ACCOUNT FOR SOMEONE YOU CANT HANDLE ANYTHING THAT HE IS SUPPOSED TO BE HANDLING FOR SOMEONE ELSE. DOES THAT MAKE SENSE??

Yeah but what exactly am I allowed to handle? I'm just making sure my bases are covered in case I need to send him back to the legal office.

ANYTHING THAT IS IN HIS NAME YOU CAN TAKE CARE OF JUST NOT THINGS WHERE HE IS TO HANDLE SOMEONE ELSES AFFAIRS. SO YOU CAN BUY/SELL CARS, OR A HOUSE, YOU CAN OPEN ACCOUNTS IN HIS NAME, GET LOANS, GO TO THE BANK AND PULL OUT MONEY, SIGN FOR THINGS THAT NEED HIS SIGNATURE. WITH THE POA HE GAVE YOU YOU ARE OPEN TO DO ANYTHING USING HIS NAME MINUS WHAT I SAID ABOUT HIM HANDLING SOMEONE ELSES AFFAIRS.

So I can buy a car? That was the whole reason I had to ask for the POA. There's a seperate specific but if those don;t work out I need to be able to get something reliable.
