I want to apologize in advance to anyone that has responded to this already.  I did this topic and did not get many responses so I am trying this again.  Ok so yesterday I dropped off DD at her dad's house after we did the Thanksgiving dinner and all.  He came up to me and asked me if he could claim her.  I told him hell no.  For one he pays no child support to me ( not that it matters but he gives me nothing for her.  I have paid for everything for her).   Does anybody know what the requierments for claiming a dependent in Florida are? ( i am not sure if there is any difference)  I told him no..but I definitely would NOT put it past him that he is going to try and be slick and try to file.  I am just a tad aggrivated at the moment with it all.  Thank you so much for your time!!

I would call the local branch of H&R Block or some place like that and ask them.  I would think legally he wouldn't be able to claim her since he doesn't provide for her, but if he has partial custody that could change things.

Thank you for your respnse.  I mean she lives with me for the whole year.  She visits him every other weekend.

I know that here a child has to live with you for 6 months out of the yr or you have provided more than half of thier support to claim therm and it is the same for the federal government.  They can claim however much they pay as child support though

 I know this like the back of my hand as we had custody of my niece for yrs and her father tried this crap every yr. Whomever the child is with more over a 6 month period. And  if he does go ahead and file you will need to file yours by hand.. can not be done electronically, if you have a custody agreement showing she is with you and he has like visits or whatever you will have to send that in. If not you will have to get notrized statements from friends and family who will stand up for you and say they know the lil girl is with you most the time and you take care of her needs. No reason to panic if he does file they will just take it out of his next  yr.. but you will still get your entire3 amount back this yr. Just frustrating cause you got to do it by mail and hand written! Hope this helps!! Clarissa

he actually has to be paying for her stuff. clothes, shoes, etc.... if he's not he cant claim her

He could try but it would be very stupid on his part!  I'm not in Florida but I don't think there is a difference.  Since you're not married he has to prove that he provides over 50% of her care and clearly he can't if he doesn't pay you the child support he should.  Like I said he could try and then he could get audited and fined.  So he would only be hurting himself.  Good luck, Mama! :)

Her dad doesn't pay me shit for CS.  I sure could use it.  But he doesnt.

As far as I know he can only claim her if it is written in the court documents and you agreed to it since she lives with you. Thats the way it is with my ex hubby since I am considered the primary custodial parent.
