I have a question about back child support and income tax return

Okay so my ex has not paid child support since last april and my husband said that when he gets his income tax return (the ex) that I would get part of it.Is that true?

Yes, that is true, but I don't know what the procedures are to collect it.

u will get what ever he owes u if he gets that much back!

Yup, it's true....say he owes you $3000 and his return is $4000....he will only get one thousand of it......

Also you don't have to do anything to get it...it will automatically come to you. It takes longer than regular taxes so don't think it's going to come a week after he files. It can take up to a couple months....but they will send it to you.

Theatrically, yes your suppose to get his tax return but if it were me, I wouldn't count on it.

You can actually call the child support enforcement center where your order is and they should be able to let you know if they are going after him for tax intercept.  They (CS enforcement) has to turn the orders sometime in November to the IRS if they have intentions to intercept.  I think to get Federal intercept they have to be 500 or more behind (by Nov) but they may go after state.  My sister in law got a number to call that gave the information from CS in the state where her ex lives.

Does it go through the state?  If he is only paying you directly and is behind the IRS won't know about it and will send him his refund.

 I wouldnt count on it either.  I am owed 20 grand and have never gotten any lump sum from taxes or anything for that matter.
