If you apply for tanf are you required to also file for child support?  Do they go hand in hand?

their divorce paperwork has them agreeing not to pay the other one child support because of what their situation is with the kids.  they each have the children the same amount of time.  we buy whatever the kids need, clothes, school supplies, my fiance even gives her money for the kids prescriptions, co pays at doctors appts and also pays the medical bills for the kids.  so even with all that he doesnt have a chance when he goes to the child support office?

 yes.......if you get cash assistance, the dad has to pay it back thru his cs. If the cs is more than the CA, then you will get the remainder of it on the Cs card or however you receive it.

the only thing that i am wondering is we already buy everything for them...I even watch the children so neither one of the has to pay daycare...she started getting tanf in october of 08 and child support division just sent him a summons and he got it in the mail yesterday..is he gonna have to back pay?

also, would tanf pay her if they knew that she had waived child support?

the state will collect it. The mother has no choice or say. WEll she does either don't accept the TNAF or do. But still if she applies the state will go after the father for child support because the state will want to be repaid for taking care of his children.

 Unfortantaly yes, he probably will have to pay every thing back to the point that the original paperwork was FILED.

My suggestion would be  get all your paperwork together,call the court, get in contact with the child support specialist - and ask about options

But as far as you said he buys every thing for the kids - Most of the time the court says that if it wasn't in an order - it was a gift ... but good luck!
