Family faces eviction over noisy toddler

A British couple may have to leave their home because of the noise their 2½ year old makes.

The Worcester News reports that Nicola Baylis and Tim Richold have been informed by their rental's property management company that it intends to evict them due to the noise complaints of one of the couple's neighbors.

But Baylis and Richold, who live in Worcester, England, claim that their toddler Skye is only behaving like, well, a toddler: She's crying and playing with toys.

"I can't believe we're going to be made homeless because of a toddler," Baylis told The Sun. "She's just being a toddler and has no idea how loud she's being."

Nexus Housing reportedly claims that Baylis has violated a contract that she signed agreeing to not run up the stairs, to prevent her dog from barking, and to cease to "use" her daughter as an excuse for noise that emanates from her apartment.

The notice follows a stream of complaints and four warning letters that Baylis received in the last year, says the Worcester News.

A senior housing officer with the rental company, Nexus Housing, reportedly said it has initiated eviction proceedings, but added that "this is very much the first stage in the process and any decision to repossess the property would have to be by a court."

Cases of management companies imposing seemingly draconian penalties over breaches of resident-management contracts are by no means exclusive to England.

Similar cases in the U.S. often involve homeowners associations, community organizations that enforce their own bylaws. Last year, a U.S. family was also poised to pay a price for inflexible rules, when the Andover Forest Homeowners Association demanded that a couple remove a therapy playhouse that they had erected on their lawn for their 3-year-old, who suffers from cerebral palsy.

Recently, one HOA attempted to foreclose on a Korean War vet because he didn't pay a $340 debt, which skyrocketed once the HOA began tacking on attorney costs. Luckily for the 81-year-old, concerned neighbors stepped up to save his home.

In yet another case, an HOA blocked a nonprofit's effort to build a home for an injured Iraq vet, claiming the proper paperwork hadn't been filed but also admitting that some residents had worried that the features of the home that would accommodate the vet's injuries would drag down property values.

Sorry, but if you get 4 warning letters and a host of complaints, its gotta be more than just a toddler doing normal day.to day stuff. Granted the neighbor(s) could be exaggerating, especially if its just one neighbor who may just be extremely crotchety. But still, in the course of one year???

My son was loud, ran around, threw things, jumped off furniture, etc and we never received one complaint in the entire year we lived at our apartment, and we had an elderly couple living below us, I was constantly telling DS to hush! Lol

After that many warnings and letters they should have a handle on the "loud toddler." good for the rental company.

They must be crazy loud, I've had neighbors like that in the past. They allowed their son to play with a bowling ball, he liked to stand on the couch cushions and drop it onto the floor. Sometimes using the excuse that it's just a kid isn't enough.

Yeah, it really depends. I had these neighbors once in my first apartment, they would constantly complain about noise that just didnt exist. It got to the point where the cops had showed up at my door twice.....asking if we turned the music/tv off or down before they got there because even standing at my front door, they couldnt hear it. And we hadnt.

The would stomp on the ceiling, one time so hard that my pictures fell off.

I was scared wed get evicted, and it got to the point that I was afraid to talk or laugh or have friends over, much less watch a movie or listen to music.

And then one time they called my landlord who was sick with the flu, demanding that she come immediately to hear for hserself. We werent even home.

They were basically told to stfu, and they didnt, so they were evicted.

To this day I have no idea what the hell their issue was with us...wed never had any other run in with them, ever and not one complaint from another neighbor, ever.Some people are just assholes, I guess.

Exactly!!! If there are that many people complaining, it is obviously more than just a typical toddler playing. When you live in an apartment complex, you need to be respectful of your neighbors and be aware of the noise you are making. We lived in an apartment for 3 years, and you could hear noise all over the building, but never anything so loud that we felt the need to report it.  My oldest son was 8 months old when we moved out of there and I was so glad!! I hated that place.
