anyone here work in HR? Serious question

I was wondering if anyone here might work in an HR department that could give me some advice. I've been on an approved medical leave from work since 11/1. I will be returning to work next week. My leave ended up being approved for longer than I had thought it would be. I have friends from work sending me messages telling me that my supervisor is discussing my medical leave with other employees that have no business knowing this information. Also they are telling me that he is telling people on the team that when I come back he's going to "fire my ass". Is this even legal? For him to discuss my medical leave information without my permission to people who are not part of management? What should I do?

Contact your HR department. That is information he has no business discussing with your coworkers. The other issue...letting you go because of medical leave is a little more complex and should be taken up with your HR as well.

I'm not in Human Resources but I do know how office/work gossip is. Don't get worked up about something that hasn't happened. If something happens - THEN - you should go to your company's Human Resource department. If they don't have a H.R. Department use the chain of commands.

Legally he can discuss your leave (as in.. Your not being there) with anyone... BUT he cannot discuss the reason for your leave with anyone who isn't in the "need to know" circle.

it's unethical and unprofessional to say the least, and almost certain it's against corporate policy (if you work for a larger organization that has such a document).  however, proving it is going to be very difficult unless your co-workers are willing to speak to HR or your supervisor's supervisor about it because it will end up being a he said/she said kind of thing, and most won't risk their livelihoods by going on record.  you could go to HR and let them know what is going on, but there's probably not a whole lot they can do without some kind of backup except have a talk with him.  then you risk retaliation (especially if he's already saying he's going to fire you, he would simply claim that he's terming you for that reason).

 i dont think they can fire you when you come back from medical leave. they can lay you off if they eliminate your postion. the girl that worked with me was laid off after returning from maternity leave cause they eliminated her position.

not a 100% sure so here is a bump - good luck

Call your HR department before you return to work & tell them what's going on. It will be hard to prove & odds are people won't be willing to go on record about it.
