504 and IEP plans help.

I know the 504 is more for those with behavior issues and such where IEPs are more for learning. How does a person go about advocating for their child to be given the other when there kid has an IEP and the school doesnt seem to want to deal with the kid at all. I am trying to help another momma out, her 10 yr old have behavior issues coupled with being a big kid the school just keeps passing him around. He has pdd-nos with some issues with authority. He doesnt lash out at the kids but has at teachers and principals. His mom would like to have him in a more specialized school or class because he is getting further behind in school. The school district doesnt want to do this because it costs money to do so. She threatens a lawsuit the school threatens criminal prosecution for her sons outbursts. What can be done?

The IEP is better to have.  By law, the school has to abide by the IEP and give the child what he/she needs to succeed in school

If they are threatening criminal prosecution I'd remind them of discriminating against kids with disabilities and how lovely that would look on the news...

My son has a 504 and a IEP,  all I can say is you have got to be persistent, call the distric and tell them what you want and be in constant contact. You are your child's only advocate.  I would tell her that threatening the school and making outbursts are not always going to get her what she wants.  tell her to stay calm.   I know how hard it can be. tell her to stay strong.

i just want to make sure i give her correct information. What all does the 504 do that an IEP doesnt?

A 504 plan is a behaviour plan and an IEP plan is for educational goals.

She can have him tested and bring in the reports or the psychologist himself.  Her school should have given her a copy of her rights and procedures.  She can also check out wright's law.  I believe this is the website http://www.wrightslaw.com/.  It will tell her about special ed laws, etc.

A 504 is for health related issues, and an IEP is for learning issues. Your friend needs to hire an educational advocate or an attorney that specializes in educational issues. Honestly, From what you have posted, your friend knows so little about the process and she has little time left learn everything she needs to know in order to help her son. A short answer to you question, is that the behavior accommodations and placement should be part of the IEP.

If the school district is not wanting to get specialists in to evaluate him she needs to keep fighting.  I would contact her state's department of education.  I would call and call and call.  Does her son not have an appointed case worker or advocate?

I am guessing she doesnt have an advocate. I dont know her well just was trying to get her some answers.
