My exhusband out of the blue texted me saying I need to sign a paper so our daughter (7 years old) can get a passport. He plans on taking her out of country in a few months for a few weeks. I told him that I will not sign because I dont want her to leave the country since it will be around the only time I can get to her up in CT (Im in TX). He wont allow her to come to me so I must travel to CT and with money tight I can only go during certain times. We have joint custody and he has primary physical custody. Do you think he can still get her passport without me? Am I being a bitch for not wanting to sign the paperwork?

Nope. I had a POA and a notarized letter signed by hubby, saying I had permission to apply for our son's passport (hubby was at work), and they still required him to be there in person, to sign the papers.
I had this same issue with my ex husband. I have full physical custody but we share legal custody. He rarely see's our children. I wanted to take my kids out of the country on vacation and needed him to sign the papers for a passport and he declined. It was very hurtful to my chidren to know that they were supposed to go on this wonderful vacation but because their Father decided to be a jerk and not sign the papers they couldnt go. It is always amazing to me that the other parent who rarely sees the child has any say so what so ever in that childs life.
Nope, he can't. My husband's ex tried to do that with his son. My ex refused to sign the passport, not because we wanted to be asses, but because she wanted to send him with stranges to three foreign countries. That was a hell no from him. His son was upset, but he told his son, that if he (my husband) had the funds and could go, or if his mother would go, then he wouldn't have a problem with it. But he wasn't comfortable with his 13 year old son traveling around the world without one of them.
No he can't get a passport for her without your approval.
Even if he could....or if she already had one....he couldn't take her out of the country without something signed by you givning him permision.
Next month I will be taking a trip overseas with our 15 yr old daughter. Even though DH and I are married - I still need to bring papers signed by DH stating that he knows we are going out of the country and is ok with it.
