How to go about leaving Dh? Please help ASAP

I believe Dh is cheating. I know I need to leave but don't want to screw myself or him (I do still care about him). We own a house together, we have a son together but out bank accounts are separate. I work but only part time (and there is no full time available). I doubt he will leave willing because his name is on the house but he knows I don't have anywhere I could go right away. I just don't know how all this works.

 things get sticky when more material stuff and emotions are involved. I wish I knew the answer for you then I could answer for me.

Contact a lawyer first. Once he is served with papers, there will be specific things outlining who can live where, and since he is at fault for the divorce, then you and your child should not be affected. Until your court date, it will be mandated that he continue paying whatever bills he has been paying... Including the house payments. If you cannot obtain an attorney at this time, save, collect evidence, screen shots, ect. Don't confront I'm, just have him served....  If, for some reason, you choose to work it out, you are out the lawyer fees, but that's it.

You should probably install a keylogger and start keeping tabs that way... record conversations you have... that kind of thing..

Talk to a lawyer, find out any legal issues with the house to find out if you and your son would be living there or your DH. Can you afford the house on your own? If not it wont do you much good anyways. Get a plan in place, save up, and go from there.
