needing a little bit of legal advice or direction

This story is really long so im just going to make it short and cut to my questions. If you want to know more you can ask. I have a SD thats about to be 12. SD mother LOST CUSTODY of her but we were in Germany (due to the Army) at the time and NOT NOTIFED AT ALL. We found out about this because the lady that worked in the office at the court house called and told my mother-in-law. When they handed custody over to her grandparents (not my in-laws) they did not change the child support. We had money saved up to go to court when we got back but ended up spending it when we moved back to the states because things didn't go like planned and they didn't have a house ready for us. We spent it on car rentals and hotel rooms (so not just spent it because we wanted to)...When we went on leave (back to Arkansas) we stopped at the court house and asked about the child support and they said we had to get a lawyer and get it changed. We want to go to court for custody but don't have the money. We at the very least want to get the child support changed because her grandparents flat out told us that the mother keeps the $400 a month....So does anyone know about how much this would cost and if it will be hard to do? My husband is about to deploy again so it will all be left on me plus my own 3 kids.

Is it possible to take out a payday loan? The only advice I can give is come up with the money ASAP and get the child support changed before he deploys again. Does the base have legal services to help out with that kind of thing maybe?

I'm not ire how things work there but in Texas the attorney generals office handles child support and you can file with them ( every county has an office) to have the support modified and they will have you go to mediation first and then if that doesn't work will schedule u To go in front of the judge in child support court. Xh and I have been once because we didn't agree on the modification he wanted. Neither one of us had an attorney

Does he pay the support to her or does it go to the state

She probably could but they won't. There are tons of details missing...if I typed the whole story it would take me all night. Basically they don't want to do anything about it because their daughter (the mother) needs the money because she cant keep a job or anything.

You do not need a lawyer for family court. If you do want one, why not try to see if you can get a lawyer to do it for free? Some will considering you hubby is in the army.

so we wouldnt have to get a lawyer? he has to pay it to the court house. they document that he paid and then call his ex to come pick up the check.

Wow. Sorry you had to go thru this. The courts have low cost/free lawyer or "counsel" services and or there are certain motions and such that they will waive. Go to legal aid and ask them. Although they themselves (legal aid dept) cant give you legal advice they will steer you in right direction. My hubby got sued (unrightly but will spare the details llol) and he paid 30.00 (I live in CA) to spend time consulting with a lawyer. Also many lawyers offer a free consult if you wanna go that way.
Is it possible you are eligible for help within the Army? Just a thought...Good Luck and I definitely would pursue it! Let us know how it turns out!

im sure this is a stupid question to many but how do I get started with going to family court? i have never had to deal with any of this stuff and now its all falling on me and i just dont know where to start.
