My father inlaw shot 2 theives....

HOUSTON  --  A retired employee of the Houston Police Department shot two men who were allegedly trying to steal a generator from his northwest Houston front porch.

Investigators say the homeowner's video surveillance system showed a strange van in the driveway.

He grabbed a gun and confronted two men who were using bolt cutters to cut the chain that was securing the generator on the porch of his home in the 500 block of Van Molan.

The men retreated to the van, say police, reaching in the passenger side.

That's when the homeowner fired about 6 shots, according to authorities, hitting one man in the head and wounding the other in the arm.

The first suspect was taken to the hospital in critical condition while the second man attempted to flee in the van but was stopped by officers a short distance away.

Although the homeowner is a registered peace officer, an HPD spokesman says he was not employed as a police officer, but as a communications specialist who repaired two-way radios.

He has been retired for about 2 years but the spokesman says the police depart is treating the incident as an officer-involved shooting

 

HOUSTON  --  Felony theft charges were filed against two men who were shot while trying to allegedly steal a generator off the front porch of a former Houston Police Department employee.

Daniel Lee Stzelecke, 32, and Frank Flores Chavez, 38, were both transported to Ben Taub General Hospital after they suffered gunshot wounds, according to a Houston Police Department statement. Stzelecke, who was shot in the head, remains in critical condition and Chavez's condition is unknown.

, a retiring HPD employee from the Communications Management Division, fired his shotgun at the suspects after he allegedly saw the men use bolt cutters to removed a chained generator of his front porch, according to the statement. Stzelecke collapsed at the scene, and Chavez fled in the van, but was later detained by HPD patrol officers on the Hardy Toll Road.

I live next door to him and i called 911 i have never been so scared in my life.  To think that it could happen so close....  I tell you when crap like that happens time stops seriously. It felt like it took them hours to get here and yet it only took 5 minutes.  I am still in shock over this and its almost been a week... My poor daughter saw it all and she won't sleep by herself anymore. She's only 2 will be 3 this month. I have no clue what to do....

Is your FIL gonna be in trouble? Here in FL there is a law that if you feel threathened in any way (such as someone stealing your stuff like in this situation) you can shoot and you wont be in trouble. I'm sorry your little girl saw it though, I hope she'll be ok soon. Good luck!

If i were you I would feel totally safe having that guy as a neighbor. Kudos for him hopefully those robbers learned there lesson!

if they were going back to their van and leaving why did he shoot? I dont get that part,,plus I always thought ppl had to be in your house to actual defend yourself and shoot them. not sure on that defense law though,,sucks your daughter witnessed this stuff though

No he's not in trouble, because they came onto his porch with ski masks on.  So he was in fear of his life and they charged at him when he shot at them.  He was protecting himself as well as the family.

as for your daughter... i am very sorry she saw that. i strongly suggest counseling..

i know she is very young...but a psychologist knows how to communicate to a small child. this is a very traumatic situation....more so than most! so i would consult a psychologist for her.

They were not trying to get away.  They came towards my FIL until he shot and then one got into the van and started digging form something and then when my FIL continued to shot in fear of his life the guy drove off....  Our houses are completely fenced in, they took the chain off the fence and drove into this yard, and then came onto his porch... My fil as a video camera on the porch and they didn't care... Thats why i believe they wore masks to try to hide their identity.

I'm thinking i may have to.  My FIL is talking to his attorney about this and what rights i have due to my daughter....  So we will see. We have a family attorney that we are also friends with so it makes things easier if that makes sense.
