Injured spouse....

Can someone who did not work...or only had babysitting income claim "injured spouse" and get her portion of her and their tax return?

Why are you an injured spouse?  If you only want to get you refund faster that will not work.  If you already have problems with the IRS you might be able to use this form, but you have to prove why you are not responsible.  If you want to file married and separate you can do that, but it means you will both have to file that way and each will be in a high tax bracket.

Its not for me. It is actually for my old child care provider.

She has the income I paid her for childcare..which I am claiming as childcare expenses...so she will be filing that she was paid that.
