Confinement to Commence 07/10/2012

County Jail
Term: 365 Days
Suspended: 275 Days
Comment: CREDIT FOR TIME SERVED, TERMS AND CONDITIONS OF THE SUSPENDED SENTENCE IS UNSUPERVISED PROBATION ORDERED FOR 275 DAYS WITH NO CONTACT ORDER.

My son's dad exgirlfriend called me and said he only gets 30 days in jail. I call the jail. He's being released on august 1st.  My fiancee's friend said he may be transfered to a prison on that day and that's why they told me that he's being released aug 1st.

does anyone know how this stuff works?

1 mom liked this
He got 1 year. They suspended all but 90 of those days. Add in credit for time served and whatnot, August 1 sounds about right.

it seems as if he was sentenced to 365 days but 275 of those days were suspended so he'd only spend 90 days in jail.  When did he go to jail?  You may be able to figure it out from that date - the confinement to commence on 7/10/12- i don't know about that.....

Thanks for explaining it.

Too bad they suspended it...

He's spent 3 days in jail for 1 battery charge, 3 days for another, and so far 1 day for another.

I was hoping for peace for a year.

i guess the pic is too small

unfortunately crimes like this are treated less severely bc of prison overcrowding. the good news is if he screws up on probation, he has to serve the rest of the term. it sucks. then when someone gets killed, everyone starts screaming that they are going to reform DV law

I agree with the other moms and it does appear that he is getting out the 1st of August.  Hopefully it doesn't cause any problems for you!

It'll cause all kinds of issues, I'll just file a protection order for my son

Where I worked, it's county for 365 or less. Unless they had consecutive sentences of less than a year. Also there is good time work time, which is two days off every six days, and "kick" for overcrowding, which is one day for every ten up to 5, then of purse time served.
