Changing my sons last name

I wanted to know if it was possible to change my sons last name and hiphenate my last name before his so called fathers last name. His father hasn't been in his life for over a year. Do I still need his permission or can I just change it on my own?

You need permission of both parents to legally change a name. Even hyphenate

You likely need his permission. He would be a fool to agree to it but you can ask.

You need his permission, I asked. I talked to a social worker, therapist and my attorney and they all said it would be a bad idea. I took my madien name back. Their Dad is very involved, BUT if he was not, I would do whatever I could to change their last name. Good luck, I hope he will agree.............

not without the father's permission, this is the reason why I was never able to add my Son's middle name.

Do you have sole custody? You should be able to but I think it depends on what state you're in

I am not sure where you live but I was able to change my son's name after he turned 1 without his "father's" permission. I had to file a lot of paperwork and since I didn't have his "father's" address instead of serving him with papers I had to have a legal ad go into our newspaper for 4 weeks in a row. The ad was to give him a chance to see when the court date was and show up if he wanted. It ended up costing me roughly $500 but it was well worth it. When the court day came I basically met with the Judge one on one told him our situation and he granted the name change.

If he's on the birth certificate I believe you need his permission.
