ok i am due april 4th and i plan to have a paternity test to prove that my babies daddy was hers because we didnt have the chance to tell everyone before he passed away and to prove he is the father to the people at the child support office. well the question is this i had heard that you can get part of his social security as payment for child support because he was killed on the job but i was wondering if anyone else has done this and how much i would be getting because it would be split between my daughter and his son, i dont want to sound greedy because i am not, most of the money would be going to her college fund. but i do want to know a range of what to expect

Wow....I really do not know which direction to go on that part. There are other benefits for children, also, sponsored by most states. In the event of death, depending on your state....some of it is also federal....there are assistance programs not only for the single parent but for the child until age 18. The first place I would ask is my Governor's office.

wow i can't imagine what you're going through. sorry i know nothing about any of this. from what i understand though you go to the ss office and file papers or something. they can as far as i know take dna tests against his family though to prove that your child is genetically linked to his family if you have to have proof. best of luck hun. sorry to hear about your situation. and no i don't think you sound greedy you are doing what you need to do for your child. *hugs*

first of all i am sorry for your loss. now, you will get his whole Social security check unitl your new baby is 18, unless he has more children, then it would be split. There is also welfare, WIC, and other things out there to help you if you qualify. And when you need support, because no matter how you became a single mommy its hard as hell, you have all of us! so if you need anything dont be afraid to ask me.

DNA can be gotten from samples of his hair from a hairbrush he used or from his old toothbrush--contact the DNA testing services online for more information on establishing paternity. As for social security you should get a monthly death benefit for your child. Contact SSA Online, get the number, call up and find out what to do next. You are very wise to be thinking of providing for your child.

My husband passed away a few years ago and he was in the military. As soon as I finished up the paperwork for them to draw his VA benefits, they sent me upstairs to Social Security. The people in SS will be very helpful (I hope...that was my experience) and walk you through each step of the way. So, go to your nearest office as soon as you can after your little gift is born and get the paperwork done and you will start collecting very quickly! It's a relatively easy process!
I will give you a heads up that at the end of the year every year, they send a form for you to fill out stating how you spent the money. You have to give bank names, investment names, etc. to prove that you are using the money for the child and not for yourself. In fact, just today, much to my surprise, I got a call from SS regarding my forms that I filled out for my boys at the end of 07. So just be prepared that at some point, they will probably check up on you!
However, you can use that money not just to save for college (though that's a great idea and I highly recommend the state sponsored 529 savings plans) you can use them to help pay for anything that provides for the child: rent, mortgage, car payment, utilities...basic needs type stuff. I just try to keep a bit of a record everymonth of how much all the bills are in case SS wants to know!

Have his family get a sample of his DNA ready so when baby is born they can get the sample immediatley and get the testing done asap. Then apply for SS right away using the DNA results paperwork. Get his Social from his family also. If he was killed on the job did they pay out anything on his death? I would think if they did it would go to his child also.
