  • Hi Everyone!

I am new here, and I am not a parent of a child with ADHD, however I am an aunt of a young boy who is autistic/PDD. He is a wonderful young man who has sooo many wonderful attributes. However our problem lies with the school that he is in.

At this time they are doing everything possible to push my nephew out of his current school, and send him some where else. My nephew is fairly well behaved in school, he does have some meltdowns, and he was sleeping for a couple hrs during the day. Now that the docs have played with his medication, (Cholodine) possibly misspelled) he is alittle more awake and participating well.

His class room teacher absolutely adores him, and has faught for him from day one. So much tot he point that she was told that she had to agree with the decisions of the CSE commitee, or she would lose her job. So during a CSE meeting she and others told my sister that she couldnt contact the teacher any more, that if she had any questions they had to be directed to her threw the school. My sister and the teacher have always spoken to each other on the phone, when they are both at home. IF my nephew had a bad day, and had to be restrained they teacher would either call to let my sister know why, and how long the "hold" lasted. Or my sister would call the teacher to find out what had happen, as they are looking for "trigger points".

But I guess my main question is, can the school remove a student because of their disability, and because their medication makes them sleepy? The school will NOT pay for any supplies needed for my nephew, they had a complete fit when they needed to hire a 1 on 1 aide for my nephew. My nephew socializes with his peers, he has never hurt them in anyway. He has also never endangered them in anyway.

My nephew does have a IEP plan, but currently no 504. But my question is what does each of those things mean? The new CSE chairman, is really determined to throw my nephew out. We want him in a regular public school, learning, and socializing with the rest of the kids. HE is very smart, he speaks with ease, he just has a few "quirks" here and there.

My sister has had meetings with pediatric physcoligist, and is currently awaiting an appointment with a pediatric neurologist. Any information ,or state laws that anyone is aware of for New York, any fighting tactics we could use with the school, would be so greatly appreciated.

My sister does have a parent advocate, and did take her to one of the CSE meetings, however you would not believe the way they were talked to at that meeting. Having the parent advocate there did absolutely NO good what so ever.

Is there any lawyers that anyone knows of that fights for these children? We are looking for any help that we can get with this situation. The school they want to send my nephew to is 30 minutes away, he will spend an hour or so a day riding a school bus. Its just unreal.

If you have any other questions, please feel free to pm me, or leave them here and I will check back as often as I can.

I hope that I explained things so that you can some what understand what is going on. There is so much going on that I know I kinda jumped from subject to subject, but my sister just went to a parent teacher confrence, and called me and the teacher told her that the CSE chairman was planning a meeting within the next 3 weeks, to have my nephew removed from this school and placed into another.

Thank-You so much for your time ,and any help that you could offer.

  • My ADHD son is actually doing VERY well in school. However our younger son is not. his Therapists have requested a speach eval and an IEP. I finally got the pwk through for the speach evaluation though they said it could take up to TWO MONTHS to do. And they said they have to see if he "qualifies" for an IEP. He has bipolar, add, oppositional disorder, pdd and agresion issures. he also has comprehension/speach issues. I dont know what to do or if i CAN do anyhthing to get this moving along... please any advice would be apreciated.

  • How do I get the guidance counselor to do an IEP evaluation on my child?

My daughter has been going to learning centers since she was 3 years old.  She attended pre-school at a school on a military post and 2/3 of a year at 2 other military post schools.  She was having problems academically at both school then started having behavior problems when she started a third school that year in Baton Rouge, Louisiana.  I understand part of the problem was being moved but when you are dealing with military moves you really have no choice.

She had problems with behavior starting the first day she attended classes in Baton Rouge.  The teacher was so stressed by her behavior that she wanted me to pick her up from school everyday at noon. The Principal also made me agree not to get a job so that I could be available at any time to pick her up from school.  The school also did 4 or 5 fake write-ups and a fake suspension.  During this time I requested an IEP evaluation and was also working with her pediatrician who diagnosed her with AD/HD combined type and Oppositional Defiant behavior.  We all filled out forms including the FBA and turned them in. Shortly after this we had a meeting with the Principal, Assistant Principal, Teacher, and Guidance Councilor, when asked about the pupil appraisal person we were told that person was unavailable. We were shown a behavior plan and things were signed but no copies were given to us.  I thought this was the IEP evaluation appointment. I was wrong.

My daughter's second time through Kindergarten was much better behavior wise but was only doing Satisfactory in every subject.  She had two days last year where she had problems in the classroom and it was due to me forgetting to give her her medication.

This school year I requested a conference with her teacher after the first 9 weeks. We had a good meeting overall.  My daughter is in the lowest reading group and she reverses her S, Z, P, D, d, B, b, a, M, W, 5, 2 and 9's. I asked the teacher for the school to go ahead and test her for dyslexia, which is now state law, and have an IEP evaluation done.   The teacher had no idea what an IEP was and was not a young teacher fresh out of school.  I was then scheduled a meeting with the School Building Level Committee (SBLC).

At the SBLC meeting only the guidance councilor was present, found out later that a person from pupil appraisal was supposed to be there.  The councilor starts out telling me she is familiar with my daughter's file and there was no IEP done or 504 plan.  She told me my child was doing too good academically to qualify for an IEP evaluation.  She pulled out my daughter's report card from last year and said " See she did Satisfactory last year".  She did not take notice that that was the second time through kindergarten for her and for someone who was familiar with her file should have known this.  She accused me of being an over anxious mom who just wanted higher grades for child and a SSI check.  She did agree to do the testing for dyslexia but only after she was told about the family history of it.  I requested the IEP eval and dyslexia testing over a month and have not heard anything from the school.

Has anyone else been rejected without it being in writing? Is there someone I can speak to without having a rejection letter in hand? I do not want to cause too many problems but I've got to get my child some help.
