PHOENIX -- A suburban Phoenix family is suing after their father's body slipped from a shattered casket after it was dropped into a grave during a burial ceremony.
Suits filed by the wife, children and two dozen family members of 50-year-old Robert Gowdy Sr. claim a strap on a casket-lowering device snapped as family was gathered around a grave last year, dropping Gowdy's coffin and breaking it open.
The suit against the city of Mesa and its workers, the funeral home, casket company and device-maker says Gowdy's body had to be pulled from the grave by two family members after cemetery workers ran away.
A city lawyer blamed the casket's sharp edges for breaking the strap. A call seeking comment from the funeral director wasn't immediately returned on Friday.
Good grief....

OK accidents do happen... but the workers ran away leaving the family to retrieve the body? I would sue too...

Seriously, shit happens. I think the wife should be entitled to something, but not the kids or anyone else.
I am a Canadian,breastfeeding (it IS best, there is nothing even close to that nutrition and bond), co sleeping, extended rear facing (if you don't rear face to the maximum of your seat, you're NOT doing all you can to protect your child), baby wearing, Non spanking (I want my kids to respect me, not fear me) ANTI- CIO, homemade baby food making, cloth diapering, organic (chemical free household!) recycling mama to TWO! My husband is my equal and best friend, not my master and I believe basic health care should be a human RIGHT, not a privilege.

Not the kids? Really they just lost their Dad and had to see something like that...and the members who had to go in and get the body out....

Hmmm so they are suing for distress? irreverance for the dead?
No offense but it sounds like someone did not get inheritance. People are far too sue happy. I am curious about this cemtary workers ran away so the family had to pull him out part. I wonder how long did they wait for the people to come back or did they immediately grab the body.

IDK, I think it depends on whether or not they knew the machine was messed up. The funeral workers definitely should not have run away. I think I would be pretty emotionally distraught to see my father's body fall out of his casket into a hole and then have to retrieve him myself. It would be an image that would never leave my mind. I would say his wife should get some compensation and the possibly his kids but the whole family is a little overboard.

Did they wet their pants and run away because they were scared? Or did the workers run to get help, or more equipment? How long was the family standing their before they took matters into their own hands? I HIGHLY doubt that the workers just high tailed it.
Also, a strapped snapped. It had nothing to do with the machine not working. It is possible that (like the article said) the edge of the casket sliced it.

This. Legally, ONLY the spouse should have ANY claim for any damages. I mean by satnders witness all manner of disturbing things due to accidents..it's not grounds for a law suit. IMO ONLY the paying party, likely the spouse, has the right to claim damages.
