Teen Faces Child Pornography Charges for Taking Racy Photo of Herself

teenIf you are enraged by just the thought of child pornography, you are not alone. That someone would exploit a minor is beyond sickening. I am sure many would agree, if an adult took a pornographic photo of a teen, he or she deserves the harshest of sentences. But would you think the same thing if a teen took an explicit photo of herself? Is it still a crime? Apparently so.

A 15-year-old Florida girl was arrested on a felony child pornography charge after she allegedly showed classmates an iPhone photo of her and another student having oral sex. A charge she admitted to, according to the police report.

What she had done came to light after a school employee seized the phone during class. In the investigation that followed, five witnesses said they had been shown the image. It's a serious charge, indeed. And the fact that she took the photo herself hasn't softened the severity of the crime as far as the police are concerned. If found guilty, this girl could be in serious trouble and possibly end up behind bars.

But because she took the image herself, many people are wondering if this is really fair? It's a tough question, namely because there was another kid involved. But perhaps it's necessary to throw the book at her to teach an invaluable lesson. Kids are so careless with images they pass around. This is not okay behavior. That said, I still don't think she should get jail time or be permanently labeled as a sex offender. Unfortunately, her own attitude about the issue hasn't earned her much sympathy. After her phone was taken, she tweeted a friend the following: "the school took my phone, long story and im in Ireland lmaoooooo." (Insert eye-roll emoticon here)

Do you think charging this teen is fair? Should she go to jail?

She should be charged. She made and distributed child pornography. I don't know about jail time, but she should be punished

I don't think she should go to jail. That seems a bit extreme. I think that she's just a teenager who was doing a stupid teenager thing. I think it was stupid to take a picture, and especially stupid to be showing it to her friends (who does that, seriously!?), but I don't think she deserves jail time.

ETA: She should still be punished.

Is showing a photo actually distributing it?  I didn't read where she *sent* the photo to anyone.

I believe she should be charged, as should any teen who takes or distributes this stuff on their social media....but I do not believe the existing laws and educational system are sufficient/appropriate for this under current practices.

The influx of social media and access to these new digital technologies changes the game.

Our legal and educational system need to adapt.

Maybe a special minor charge that goes away at age 18 with some kind of probation/required education as a penalty?

We also need to address this topic in schools, beginning at an early age.

If she has to register as a sex offender ... Then the law will need to changed.

 Jail is extreme, I think, but the kid definitely needs punishment and counseling. That is worse than being stupid,in my opinion. First, why is she even having oral sex at her age. AND why is she photographing it and showing it around?Next stop is Hookerville for her if she doesn't get treatment. SHe's just not playing with a full deck! Her parents have dropped the ball ....she is not being raised at all. No morals, no standards, no self respect or respect for others. If I was a teen and saw those photos on her phone, it would traumatize me. Seriously!

This is just horrible.

Would be interested in what her school teaches students about sex.  If the school is handing out condoms and teaching safe sex she is doing nothing more then what is being taught.

Why is child pornography wrong?   What is it about child pornography that is bad?  And is that aspect present in this case?

Those are good questions. I'm not sure I'm awake enough to answer them atm.

it's wrong because someone decided that it was bad to have naked pictures of children.


we discussed this topic a little in my criminal law class and i don't remember a ton.

You have me stumped. I can think of reasons it is bad, but like everything it's only bad because someone said it was.
