HOUSTON (CBS Houston) – A 10-year-old girl is facing rape charges from playing an alleged game of “doctor” with a group of children from her housing complex.

The girl, who is only identified as “Ashley,” was charged by police for aggravated sexual assault.

In April, Ashley was among a group of children who were playing doctor, KRIV-TV reports. A neighbor saw the children and called the mother of a 4-year-old boy who was also playing in the group.

Houston police say that Ashley was inappropriately touching the 4-year-old boy.

“I’ve never dealt with a child this young being accused of a crime,” Quanell X, who is working with Ashley’s family, told KRIV. “In fact this was nothing more than inappropriate horseplay that has now led to a child that is 10-years-old being charged with aggravated rape.”

Ashely was held for four days in the Harris County Juvenile Detention Center in June.

Ashley’s mother calls the situation a “nightmare.”

“It’s a nightmare even having to go through something like this because that’s my baby, that’s my baby and just the thought of her going through something like this it hurts me,” the mom, who wanted to remain anonymous, told KRIV.

She went on to state that she was not allowed to sit-in on the 45-minute questioning of her daughter.

Ashley’s hearing will be in October for sexual assault charges.

What do you mommas think? Is this a sign of a pedophile in the works or just an example of things being took too far by the adults? Should she be in juvi hall to become a very REAL criminal or released for some counseling? What say you?

It sounds to me like it's prob something the parents are taking to far but I'd need more details. Naturally kids will look at each other and even touch each other. At 10 she's prob not old enough to have a real understanding of why what she did was wrong. She should be taught it's wrong not treated as a criminal.

OMG.
This is a case of adults being perverted nutters and completely unable to talk to the kids about why it's not OK.

BTW Why the hell wasn't there a parent with the FOUR year old?

often older kids are sent outside to keep an eye out on the younger ones. That is nothing new.

I personally think these people are nuts treating a 10 year old like a sexualized pre adult attacker.  More than likely what was being acted out was not even close to sexual at all. Pathetic really

Aggravated rape seems like a very inappropriate charge based on the article, but we don't know the details of the case and in fact it could be much worse than what is presented here.  Generally, a 10 year old knows not to touch a 4 year old in certain areas and personally, I would be quite concerned if I came across a 10 year old touching a 4 year old in an inappropriate manner.  Most 10 year olds are aware of what is and isn't okay to do, where it is and isn't okay to touch.  I'm not sure the girl should be charged with a sex crime, but I definitely think she should receive some form of treatment and her circumstances and living situation should be scrutinized.  Often times kids who act out in this manner and victims of sex abuse themselves and are reinacting the crime that happened to them.

That or should could be acting out what she walked in on mommy and daddy having sex. That innocent act could have been excused by the parents as it is ok mommy and daddy are just playing doctor. for an example. And there ya go...

what is aggravated rape?

A 10 year old touching a 4yo is kind of off.  Not enough information, what did the other kids say happened.  Even if the 10yo walked in on mom and dad still doesnt excuse touching a 4yo ...it really doesnt excuse playing "doctor" with a 4 yo.

When i was in juvi there was a 10 year old boy who had been there for 2 years for molesting his 4 year old cousin. the other kids there were so mean to him. I still think about why would he do something like that being so young he was 8 at the time. Another boy that was there at the time said that he had said he was just copying what he had saw on a video he found.(dads porno) he seemed like a normal kid.

playing is playing. We do not even know if this child is not developmentally delayed either. I mean it says the neighbor saw what was going on and called the 4yo mother. Why was she not watching her child was a older sibling present and playing too?  There is too many missing variables. Like what exactly did the neighbor see?

On TV you see people having their clothing cut off to put on a splint or cast. Maybe she had took off his pants cause he had a "broke leg" and maybe accidentally removed the undies in the process. It is not out of the realm of possibility. Too much is missing but having her in juvi is stupid cause it will teach her some seriously bad shit in there. Juvi is pretty much a place to guarantee that the create a much bigger criminal.

That is what I am thinking. I mean there is so many things they dump kids into juvi for that is stupid and not called for. I mean if he flat out murdered someone ya juvi cause I do not think he will ever be normal for release purposes. But this type of thing... I remember playing doctor and thinking about it now I can just imagine things that paranoid adults would have thought was going on that wasn't.

There is not enough information to judge. I can say, a 10 yr old knows not to stick a finger up something on a 4 yr old. So without knowing what the 10 yr old did.......? I am not giving her a free pass BTW.
