Did this couple deserve to be arrested for leaving their three children home alone?

Mother of 3 Arrested for Leaving Kids Alone So She Could Get Tattoos & Drink

A mother of three from Brooklyn wasn't about to let anything stop her from getting more tattoos -- not even the itty bitty little fact that her young children probably can't stay home alone for an entire night, at least not in the eyes of the law. Laura Aguero-Dupla, a 35-year-old middle school teacher, has been arrested and charged with endangering the welfare of a child after a neighbor heard a loud noise in her apartment and called 911. It led cops to the discovery that she and her husband left their three kids -- the youngest is 4 and the oldest is 12 -- so they could go out drinking and to get tattoos.

Aguero-Dupla and her husband, Alfredo Bobe, 41, reportedly decided to make a night of it when they visited a Manhattan tattoo parlor so the woman could have one of her tats finished, then stopped off at a bar. They would have probably gotten away with what they did, I mean, assuming that nothing happened to their children, God forbid, but then either their drinking or tempers probably got the best of them because they reportedly wound up having a raging fight at the bar.

Bobe reportedly left his wife and made his way back to their home, only to realize he had forgotten his keys inside. For some insane reason, he allegedly felt the best thing to do in this situation wasn't to wait for his wife to get home with a key, but to punch out the glass panel on the front door -- at around 2 in the morning.

The noise woke up a neighbor, who called 911. They reportedly found Bobe pacing outside of the apartment building and later arrested both Aguero-Dupla and her husband, whom they charged with criminal mischief and acting in a manner injurious to a child.

Their children were taken away from them and are currently staying with a relative, according to police. Aguero-Dupla, meanwhile, has been pulled from her classroom.

The couple has been in trouble with the law before.

In 2011, Aguero-Dupla was charged with criminal mischief for reportedly punching a motorist and denting his car on purpose during an incident in which she was on her bicycle. Bobe has reportedly been arrested twice, including once for assault in 2003.

Although some states have imposed a minimum age in which children are legally allowed to stay home alone (and it's usually about 12), New York is not one of them. This leaves some of us to wonder whether what this couple did was illegal or just foolish. Or neither.

Damn right they should have been arrested and the children removed.

At first in this article I thought no....depending on the maturity of the 12yo. I was babysitting young children at the age of 12 (although not until 2am!). But reading further into the article - parents getting into a brawl at a bar, punching out glass windows, not getting home until 2:00am, etc,  etc. The parents sound very immature and irresponsible and I agree with the outcome of the situation.

My first thought, I don't see why a 12yr old can't babysit.  However, their behavior was downright deplorable.  I still don't see why they were arrested and their children taken away though.

Likely because they were drunk, violent, and considered people who put their children in danger.

The reason they left the kids home was not good.  However, a 12 year old is probably old enough to babysit.  I don't think it warrants an arrest.

At first no...a 12 year is not to young to look out for the younger ones.

But stoping by a bar....a bar fight...not getting home until 2....thats no good

Twelve is definitely old enough to babysit, but I wonder why no one in their apartment heard the glass break and where they were, if they were afraid, or if they are used to this type of behavior from their parents.  I babysat at 12 and the parents came home late; however, they came home sober.

Being an irresponsible parent, even the children are of the age that seems appropriate, deems consequences when their actions have a negative impact on their children.

These parents, in particular, seem to have a pattern of sorts and no doubt they would go out partying again, leaving their children to fend for themselves.  If something had happened to the children we would all be up in arms over the parents actions.

We wait until something happens.  That shouldn't be the case.

I admit, right now, I am disgusted with the behavior of some parents, one in particular, so it may very well be clouding my judgment.  Parents need to step up and take responsibility for their actions.

For the babysitting, no. I was babysitting at that age, as was my daughter. For the other behavior, yes.

 I agree with you competely. I can't imagine people like these two would be good parents and good role models. They need counseling. But ,maybe it is too late forcounseling for them. They are in their 30's and behave like ireesponsible and crude teens. Going out late drinking too much ,getting tattoos and fighting with people? NOT a good pair of parents. It sounds like they have had a bad influence on their kids already. Too often terrible things happen to kids that COULD have been prevented.
