You are not home. Your kids throw a party where alcohol is brought in. Someone gets drunk and gets in an accident. Are the parents at fault?

A) Im not home. B) Alcohol is brought in not taken from my personal stash.

Am I at fault? Um....nope.

If I knew ahead of time about the party and chose to leave the kids anyway then yea, Id be part to blame

Are their parents at fault? They would only be responsible IF they knew their kid was going to a party and was going to drink.

I don't agree with it but yes they are.

It is like the situation where a burglar gets hurt in your house while robbing you.  It doesn't make sense but it is the way it is.

Hahahaha....now, don't hurt yourself.  Did ya come up with that all by yerself?

Ahshit...maybe that thing about a burglar having the right to sue a homeowner whose house they broke into is making the "let's whip up the RW" chainmail rounds.

As far as parents being responsible for their child's behavior: as long as they did not know about what their child was up to, the child is responsible.

In the eyes of the law, however, the parents may be held liable for the actions of their child or the consequences of their actions.

Yes you are. It is a parents responsibility to know where your kids are at all times, and what they are up to. I know some of you might disagree with me, but realistically, until that child is over the age of 18, you are responsible, period!

Ditto the responsibility falls on the property owner.

It doesn't matter if they are over 18 in this case as long as the person who has the accident is under 21 the responsibility falls on the property owner. You as a property owner, or if you lease it is termed your property, are responsible for acts that happen on your property, so if a person under 21 is served alcohol at your residence you bear the responsibility just as if you had given it to them.

Kids should be held responsible for their own actions, no one makes the kids these days pay for what they have done......Legally yes it may be the parents are liable, but I think that is wrong.

I can guarantee you that if I was to have some kind of problem due to my child(rens) irresponsibility, they would pay, big time! There is no such thing as a slap on the hand BS in my home.
