Worried about step kids living situation.. what would you do ? What should we do ?
Firstly a few months ago my step kids birth mom got caught shop lifting with the kids ( the kids had about 200 dollars worth stuff on them and its not the 1st time). Bm would not provide cps with my dh name at first ( even though his sons name is justin jr). My dh didnt get contacted about step kids being put in their aunts custody etc for about 2 months.. my dh has had same phone number for atleast 3 years! Ok now bm has moved back to Kansas ( she has moved back and forth from kansas colorado and nebraska since the kids were little . the state of Colorado gave her the kids back.. but the living condition is still no good in our eyes. bm step daughter 11 and step son 10 all share 1 room in a friends house and sleep on the floor where carpet has been torn out( its like rotten wood) the kids have cut their feet on nails sticking out etc... now bm has gotten a job working 3rd shift. Although I dont want the whole headache but I truley believe the kids would be better off in our care. They already are coming over Friday sat and sunday nights. I believe they deserve better then what they are being provided. Even if its only tell bm gets on her feet ( yet again she ups and moves like this every year .. from homeless shelter to homeless shelter as well). What is the posiablity of us getting custody if we go to court ?

There is a good group on here that discusses Custody Issues. It may be a big help to you. Go to the groups tab and search for custody. I know their is also a group to ask Legal Questions in. Just search Legal.

My advice is to contact an attorney and get things rolling for custody. Your chances of getting custody sound pretty good to me. Another thing, contact CPS with ur concerns. They will investigate and if they feel just like u do that those kids are in a bad enviorment they will remove the children from her care and into yours which will help in the custody case. i def think that if dh pushed to get custody he could based on her living conditions now and in the past and her instability and legal issues..
he should try to get a lawyer and push for full custody, given the situation he might not even have to get a lawyer. every court house has the necessary paper work you can fill out to start your own custody case. me and my husband did it for his son by ourselves and we now get regular visitation every other weekend, it was quite easy to do.
