wondering about DH's child support...

DH and i have been together for 8 years. He has been paying child support to his ex gf the whole time. There is neither a paternity test to prove the child is his, nor a paternity aknowlegement document. She even states this in the court records. She has denied him a DNA test, and refuses to let him be a part of the child's life. Also, she did send him 1 picture of his "daughter" but my husband is native american with very strong dominate features. Black hair, dark brown eyes and a darker complexion. Even a cleft in his chin. His ex has the same color green eyes i have. The child in question has blonde hair, blue eyes, and very pale complexioned. Our 2 boys have light blonde to dark brown hair, and both if them. Have dark brown to black eyes and a darker complexion. Both of them even have a slight cleft in their chins. They never established paternity, or that he accepted responsibility for the child otger than signing the birth certificate form. He went back to work the following morning, and neither of them seen a notary. She admitted a year later that she cheated in him within the same week. Now, because hes been unemployed since march, and havent been able to send in any payments, they are threatening to revoke his drivers license and arrest him for failure to pay. They are aware of what his work pertains to, and to revoke hia license would prove both nonproductive, and irresponsible on the states part. Can the state be obtaining these payments illegally? Could they be coercing money from him by lieing to him about an akmowlegement form? He has called the hospital where the baby was born, the courthouse where they lived and where the baby was born and all 3 places say there is no such dilocument. But the state we live in says their is but has failed to produce the document.

Its unreal! His record for makong payments has been spotless the last 7 years. Any advice or thoughts?

My dds sperm donor is na as am i and of course she is. She will be 6 soon. I have court papers stating that due to his failure to respond on 3 diff occassions he is legally her father by default which is what couldve happened with him. Btw i am more navajo and mexican than anything else in me but irish is what you see in me even with the domanance(sp?) of the other things in me.

If he pays child support he should have first gotten a paternity test. The courts usually dont mess with that stuff cause if shes not his the ex has to repay it all. Go to court and DEMAND a paternity test. They can't deny it they have no reason to.

And yeah. I would get a lawyer.

My hubby is native american (part) has black hair dark skin and brown eyes. Our DD is a flaming red head pale pale white with blue eyez. This the other child looks nothing like my DH so how do I get his CS stopped posts get really old and sad!

Is Dh a registered tribe member?

You may be able to get help from the tribe proving or disproving she is his so that she can be registered with the tribe. But it would probably depend on which tribe on how much they may help. Ours will help with a lot of stuff but the stipulation is you have to live in one of 8 counties (which we don't LOL)

His ex even stated she is unaware of any forms and no dna was established. The courts are going by her word alone. So long as it is in the state its carried in, any town would do to get it taken care of. We are going to get some things paid up so we dont loose our home and our boys are not reaping the consequences. Them get a lawyer and go to a city she doesnt have the system wrapped. She denied him a dna test, and a continuance before, not the court. The judge just signed off on it. And it will hit her and the state out if the blue. Our state wond do anythibg to help us. They instantly deamed him a dead beat dad just because he isnt with her, has any visitation or anything. I have handled everything with his child support issues since we got together.

I just wanted to add my Dh is American Indian. DS has blondish brown hair, blue eyes but he has that kinda "grayish" Indian complexion,
DD is fair with redish blond hair. LOL.

Ya know, i realize not ALL of the dominate traits are going to shine through, but not ALL recessive traits do either. She doesnt look anythibg at all like him or her "brothers" are you blue eyed, and red headed and very pale? Its possible, from what i learned before some dominant traits will come through unless theres something fishy. I have irish as well, but i dont, nor do my kids have red hair. I have my dad's blonde. So i haven't seen many other posts saying anything like this. So please do us a favor and put your holier than thou attitude in your pocket honey cause no one has the patience for it.

WOW just a little defensive huh?  No holier than though just my experience and opinion about these types of posts lately.  This "I am the new woman I want to figure out how to get rid of my mans financial obligations so he and his money are all ours" is sad to me.  Its a public forum and people have different views and experiences.  has nothing to do with being holier than thou or what ever excuse you want to throw out for being so defensive.  There is NOTHING fishy in my DD's conception and she has NONE of my hubbys so called dominant traits.  she is my mini me. Genetics are not as cut and dried as you portray them.   And through other posts I have seen here I am not the only one who has had this experience.

If this has been in question for 8 years why didn't he do anything about it back then? why wait until 8 years later?

It also doesn't matter what a man/womans record is for paying CS. If you stop paying, legal action can be taken.

Its not that i want his financial obligations out of the way, just want to know for sure the child is his. She admitted she cheated on him. If the child is his, i would like to see him and her develop a relationship. He deserves his parental rights, she has kept her from him for 7 years. And honey, we have been together 8 years. I just dont want to see him end up paying for a child that may not be his. And if she was absolutely positive she was his, she'd give him the dna test to prove it. No denial. Course she also thinks because he was denied a continuance, he will be denied an appeal.

He needs a lawyer. The first thing a judge does is establish paternity.

Get a lawyer and a paternity test ASAP!!! It can be court ordered.
