My son to be ex son-in-law demanded a paternity test on their last child (he's the forth). The baby is now almost 5 months and he has never even made any attempts to see him. Even his mom during the child exchange won't make any eye contact with the baby if my daughter is holding him. Really sad.
He has no reason to doubt its his but he and his lawyer are playing every dirty trick in the book to make the courts think my daughter is a pill popping mentally unstable psychopath.
He has his lawyer convinced that the child isn't his and they DEMANDED the test. It was court ordered. Big mistake on their part, because when he found out the cost he changed his mind but still denied he was the father. Her lawyer reminded them it was a court order that THEY DEMANDED the test. My daughter has no worries, she is 100% positive that he is the father. They wanted half the cost from my daughter. Her lawyer declined, his lawyer shot back with WHEN the test comes back that he ISN'T the father they expect half. Her lawyer more than happily said they would pay.
Her biggest concern is that for some reason his lawyer is setting up the testing which my daughters lawyer told her that he knows the lawyers do not become involved in the lab portion of the testing, he also reminded his lawyer of this. His lawyer is cut throat and is known for winning at any cost. My daughter is afraid that he might possibly compromise the testing. The test will ultimately show that he is the father if used by a reputable lab. This lawyer does NOT and will not lose so of course she's nervous.
Its not paranoia on her part. They've lied about anything and everything even when it came to the sale of the house she found out that it his lawyers GF was handling it. And now with his lawyers insistence of handling the lab she is nervous. I told her to ask her lawyer if he could recommend a lab or to call the court and see if they could. I don't trust his lawyer given his reputation. Her friend told her to buy a Paternity test kit and bring it to the court when they go and have it done in front of the judge. This has been never ending and I am sure that their next court date will be continued with nothing resolved.

if she is worried about a compramised test, then SHE should pay for it and get it done at a place of her choice. simple really
Labs are not going to mess with the test. They could get in big-big trouble like Prison time if caught especially if they are doing DNA testing. I'm pretty sure they need some sort of extra approval to do court ordered DNA testing.
Usually the testing is computer generated and they can't go in and change it. I used to work in a doctor's office/lab and that's the way our blood testing was but we didn't do DNA testing though. We did drug testing sometimes, I know I had to be approved and have extra training just to do that.
I really hate to say it, but it sound like her soon to be ex really does not believe that the baby is his. Hopefully, when he finds out that it is, that he will be a better parent.
The lab used is NOT going to place THEIR reputation and business on the line for anyone. The results will be valid.
If the lab results shows that he is not the father, for her to take a OTC paternity test into court and requesting it done it then, I can pretty much guarantee that a judge will decline allowing that, and dismiss any results - whether positive or negative. His response will probably be, if you (your daughter) wants another test done, you can certainly pay for another test done, in addition to paying for the original test. That's BEST CASE scenario, the worst case is she will be sanctioned for making false claims against the lab without proof.

I had to do a paternity test with my son's father (he told me flat out that he didn't doubt that our son was his, he just wanted to put off child support for another 3 months. Lovely). I was worried that my son's father might try to do something shady like have someone else go as well.
She should stipulate that the test be done through the Health Department (or wherever the DCSE office in her area uses). We went there and they require picture ID and took my photograph for the records. I'm sure they do it enough that they are very good about not letting people cheat.
i had to go thru paternity testing too, my ex was just delaying/denying the fact that he was the father. when i took my daughter in to get her mouth swabbed, they were very accurate with the picture id and info...i was also very paranoid about the results, but i knew without a doubt that it was his.
waiting for the court day was so stressfull, to hear the results. but the look on his face was priceless! LOL :)

This is good advice. I also deal with labs and the procedures the tech's have to go through are specific for the collector and the labs. Once into the lab any tech could get it and I cant see any lab agreeing to accomidate a attorney. The attorney cant control the outcome of the test.
Lawyer can't mess with the results. Someone from the lab or a NP will take the DNA (Spit or blood) and take it directly to the lab. Lawyer doesn't even need to be there.
