Nope, the requirements are at least 4 years old and 40lbs.

He shouldn't be in a booster until he's at least 4 years old.  You should put him in a forward facing 5 point harness.

there are some belt positioning boosteers that have the 5 point harness too. And that way when he is big enough you can go to the belt positioning part.

Take a look at this page for some good information:

What is your budget?  I can recommend some seats.

Def not a booster.

You will need to get a high weight harness seat for him.

the current favorite is the Graco nautilus for $144.  it harness to 65lbs and then converts to a high back and a low back booster seat so it will be the last seat you need to buy for him.

or the Apex 65 harness to 65lbs then a high back booster to 100lbs you can get them on albeebaby.com for $89 but you MUST have a head rest behind it.

or if you can afford a little more the Britax Frontier is what we have for our son - it harnesses to 80lbs then turns into a booster to 100lbs.  DS loves it. they are on sale right now for $229

Target also has the Britax Regent on sale for $179 - it harness to 80lbs but you will need a booster seat afterwards unless you go straight to the vehicle belt.

the laws are constantly changing and being updated in different states and so are the recommendations.  as we learn more about how the human body developes and reacts in accidents they are building seats to protect children more and changing the recommendations.

most car seat recommendations actually have to do with skelton age and the way the bones ossify (harnen) and the way the spine fuses. so even though he is a big boy he still has the bones of a two year old.

What do you mean about having to have the headrest behind the Apex?  I'm needing a carseat too (for a 3.5 year old).  It will only get uses 1x a week at most so we want to spend the least amount possible.
