Yesterday, I get a call from my step-dad. He says some guy named Jeff Hamilton called him and said that I owed some debt for a loan. And if I didn't call within 15 min, I was going to be charged with fraud and be arrested.

um. oookkk......

So I call and ask for this guy. First of all, he has a thick accent. I may be wrong, but it sounded Indian. So he's basically telling me that I need to pay him $1,452 for a payday loan I took out in 2005 (um, which I shamefully admit went into bankruptcy along with many other debts in 2005). And that if I don't pay that day, I'm going to be reported to the authorities and I will be charged with fraud and be arrested.

I ask him what company he is collecting for and he gets a HUGE attitude and continues to threaten me. I try and talk over him and tell him that unless I get proof that this is real, and I get actual documentation from this company, that I am not paying anything. The info he proceeds to give me is my full name, social, old address and banking info from 2005. He also had the phone numbers for my mom, step dad and brother in law. He says that's his proof and now I need to pay.

I told him that he mustve stolen the info from the payday loan company and that thats not proof that this call is real. He continued to threaten me saying that my life was going to be ruined and that I would lose everything b/c I was going to be arrested. He said if I couldnt pay today, that I could make payments. $200 right away and $200 every other week. And that once I paid the balance, I would recieve the info I was asking for.

I hung up. He called back about 12 times. I answered again, and once again he started with the threats. I gave in and gave him my debit card #.

I must admit I was scared shitless of being arrested and charged....as I have never done anything illegal. I started doing some digging and found info that this is a scam. I immediately called the bank and cancelled my debit card. I reported it to every website I found where people were either victimized or called. I called the police, the BBB, the FTC. Below is some info for you ladies. Please vote this popular or pass it on!!!!! Thankfully, I didnt lose any money (as my account was empty and I cancelled the card 15 min later)

This is a complete and total scam. First of all, I filed bankrupt in 2005. I dont owe anything to anyone. Second, you cannot be arrested for a debt. Sued yes, arrested and harrassed, no. And 3rd, you always recieve some sort of written notification. I have never gotten ANYTHING in the mail.

Great info - thanks!  I'm sorry he harassed you, but glad they didn't get any of your money!

Yeah, if you included that debt in a bankruptcy, he's breaking the law by trying to collect for it!!! If he calls again, tell him you didn't fall off the turnip truck yesterday, and he's been reported to the proper authorities, AND that you're recording his conversation. That should scare him away. They cannot, and will not arrest you for a debt that has been discharged. If it hasn't been discharged yet, refer him to your attorney as they're not allowed to contact you once you've filed. You were smart to do some more checking up on this!! Many people get scammed and don't even realize they've been scammed! Thanks for warning people.

It's a good thing you cancelled the card. The LOL will be on him if he tries to extract any monies from it.

toris...

What about him having your social though?  That's pretty scary and how did he get that?  It would probably be a good idea to do some credit monitoring for a while.  I really wonder how he got it....

Eveh8...

He got all the info from a payday loan company. I did put a monitoring service on my credit, but its not like anyone can get anything out of it. My credit is AWFUL. But, you never know, so I did it anyway.

LOL  I always say that if someone stole my identity they could only improve my credit!
