Well, it has been another year in this roller coaster marriage of mine. Thought things might be getting a little better but that old evil reared it ugly head again today.

We were due to get back $5, 200 on our federal income taxes and I have been waiting so patiently. We had such plans of what to do with the money. The money was due here on 2-13. I got a letter from Chase, the bank my tax service uses saying we weren't eligible for the next day loan. Well I already knew that as I filed my taxes over a week ago. They cited that we had a debt with the IRS. I already knew that too. It was 177.00

Well I went by the tax place and the lady said that the IRS had gotten their money but there was another comapny saying we owed. She gave me a number becasue she said she couldn't tell what it was in reference to.  When i got home and called it was the child support enforcement. Even though we are on a payment plan for my husband's kids, they took all my refund.

I don't think that should be right. The earned income credit was for my kids not his ex wifes kids. They are not even filed on my taxes. So she gets to have my money and spend it on her kids but my kids get nothing. There ought to be a law about that.

I don't know your situation, but you might want to file separately next time instead of jointly. That way, they will only take from his refund and not yours. It is not right that your children miss out, but if the other children are his, then they deserve his money as well.

OMG!  WOW!  I don't even know what to say to this.....I can't believe they took it either, I mean didn't they see you guys were on a payment plan?  Or I guess that just doesn't matter.  I'm sorry but thats BS.

hey Jess, I am really sorry this happened to you! When you file there is something called an "injured spouse" form...that prevents anyone from attaching your income as well...you may have been able to keep some of it.  The courts didn't send anything to you guys telling you they were attaching to his tax return, I thought they were required to do that!

Feb. 6, 2009 at 7:31 AM They did that for several years to my hubby and I cuz 15 years before he had given her a (jarge) check and she never reported it to Welfare or Child Support- so they claimed he was in arrears. He did not keep paperwork (young and dumb! LOL) and state kept adding interest to it. $3000 turned into almost $16,000!!! We finally paid it off (with all of those *stolen* tax refunds... it really pissed me off too. The interest goes to the state, not the kids- that is what makes us so mad. That, and the fact that they also took his driver's liscense away, making it illegal for him to drive to work!! How they expect people to pay child support under these restrictions is ridiculous. He was so mad at authority for so long- still is actually!!- and who can blame him?? He did everything he was supposed to- including trusting the mother of his child. She also dominated his relationship w/ their daughter- NEVER let him have her over night... she NOW lives with us- at age 25!!- and they have FINALLY been able to build a good father/daughter bond/relationship!!!
The Injured Spouse thing is important- def. remember that for next year!!
