Woman Raped In Parking Garage In Front Of Children

STAMFORD, Conn. -- Lawyers for a Connecticut hotel where a woman was raped at gunpoint in front of her children are putting some blame on the victim, saying in court documents that she was careless and negligent.

 

The papers filed in Superior Court by the Stamford Marriott Hotel & Spa last month are in response to the woman's lawsuit claiming the hotel failed to prevent the 2006 attack by Gary Fricker. He's now serving 20 years in prison.

 

Prosecutors said Fricker assaulted the woman in her minivan in the hotel's parking garage in front of her two children, then 3 and 5.

 

The victim, in her suit against the hotel, calls the conduct of the hotel and garage "extreme and outrageous."
The suit claims that when at least one employee noticed Fricker loitering and acting suspiciously the day before the attack "no employee of the Mariott Hotel or any of the other defendants took any steps to question, interrupt or otherwise discourage the assailant's conduct."

 

Lawyers also wrote that the hotel and garage were negligent because they didn't' take "reasonable security precautions" and failed to "adequately monitor and patrol" the lot.

 

The hotel's court filing said the woman "failed to exercise due care for her own safety and the safety of her children and proper use of her senses and facilities."

 

The woman's lawyer didn't immediately return a message Thursday.

I'll still stay there. She's filing IMO a frivolous suit. It is NOT the hotels fault that she got raped. They have numerous guests, how are they supposed to know that the creep who raped her wasn't a guest or a friend of a guests? It's a hotel, people come and go constantly.

TBH, she kinda started the whole thing by placing blame where it should've never been placed. It's one of those sick things that just happens, the only person to blame is sitting in prison. If she didn't want to hear about possibly being neglectful (I don't think she was) then she should've never filed the lawsuit.

This statement right here is what gets me.  Why wasnt security about someone acting this way?  Why didnt anyone do anything?   I am sorry, I stay in alot of hotels, in fact I am staying in one right now and they have not only camera but security walks the property every hours from 5p to 7am.   Yes, I do think it is the responsibility of the hotel to maintain an safe environment when you are paying to stay there.  No different if you were renting a house and there was lead paint on the walls.  You would expect your landlord to pay to provide a safe environment because that is what you payed for when you agreed to live there.

If this is true then she should sue. There should be cameras AND security walking the parking lot from sun down to sun up. Now if they did everything they could then no, she shouldn't sue. I'll tell you one thing though, even if they're not to blame I still won't stay at one because of their awful comment.

Their statement was unfair, but the blame for the attack does not fall on them. It falls on the rapist. I have been a victim of a sexual assault and I didn't blame the property owner.

A hotel can only do so much. How much would a room cost if they had enough security to watch every corner of the parking lot and every corner of a parking garage at all times? ALOT. My DH worked hotel security when he was in college and even with two guards on duty there is only so much they can do at one time. There could have been 100 guards there that night and she still could have been raped. It is not the hotels fault.

Their comments- callous and unnecessary. But her lawsuit is unnecessary too.

I have to agree with her.

My mom works at a hotel and there is no security walking around etc. I know a lot of places have security etc but a LOT of places don't. I guess people should ask before they stay there. Yes one someone saw him acting weird but if it didn't happen again that day or the next day before the rape then the hotel or who ever saw them didn't know this would happen. It is not the hotels fault and is NOT the woman's fault. I feel for her as I was molested as a child but the blame can not go on the hotel just for the hell of it. She got her justice with the man going to jail. Now it sounds like she needs to get counseling.

That's ludicrous to expect a hotel in an area with less than 150,000 people to keep up security like that. Maybe, if the hotel was in a metropolitan area where crime was an issue I'd understand having expectations like that. But I've lived in an area a similar size and there would be NO reason for them to ever suspect a violent crime like that would happen on their property and it would be a complete waste of time and money for hotels to have that kind of added security in such a small area.
