I'm confused and lost at what happen to my husband today. My husband has been out of work on medical leave for 11 months now. He had major surgery and many complications. Before surgery we were told he would be out of work for 12 weeks to 18 weeks. After surgery we were told at least a year he would be out of work. My husband told his boss everything. My husband always informed his boss of what was going on. My husband also brought in dr notes every 6 weeks. The boss knew my husband would be out for many months. BUT the boss always said don't worry your job will be here when you get back.
Today my husband went to work to see what he had to do to get back into work. He drives for a living and their are many DOT physicals and paper work. My husband went to his boss, and the boss said your job is gone. You do not have a job b/c you were gone to long. But the boss did say my husband could start at zone 1 again and work his way back up. My husband has worked for this company since 1992. My husband has been a zone 4 worker for 13 yrs. My husband was lucky to get to zone 4 so fast b/c a bunch of zone 4 workers lost their license for DWI's and failed drug test. So my husband leveled up fast b/c he was always on time and never took a day off. Plus he got his work done on time and done right the first time.
My husbands' job went to another worker and it will not be given back to my husband.
I don't no a whole lot about your rights when you are on medical leave.
Can an employer take away your job and give you the lowest job when you come back from medical leave? Their are no cuts at this company. All the jobs are the same as they were a year ago.
Can a employer cut your hours and your rank when you come back from medical leave? My husband hours are cut to 4 hrs a day. He was working 12.5 hrs a day.
I always thought an employer had to keep your position for 12 months. The same hours and the same pay. Am I wrong about this?
Oh this company is big. This company has many offices across our state. With at least 15,000 employees. And this company is always looking to hire more employees.
Where can I research about employee rights and what kind of lawyer should I get?
