My son is 13 and has decided after some issues at his fathers that he don't want to go. His dad is insistant that he has no choice in the matter - he says that "by law" our son "has no choice". My ex has not pushed the issue and my son has not gone to his place since Halloween weekend.

I want to know if anyone knows if there is an age in which the child does have a say?

It depends on the state but in a lot of places, when a child is around your son's age, they can make decisions about visitation.  But you do have to do it in court so it becomes part of the official custodial agreement.
