FILING TAXES AFTER BEING DIVORCED??? PLEASE HELP!!!!

MY X AND I WERE OFFICALLY DIVORCED ON NOVEMBER 15. HE WAS IN SUCH A RUSH TO GET THE DIVORCE GOING AND FINALIZED THAT HE PRETTY MUCH GAVE ME WHATEVER ME AND MY LAWYER ASKED FOR. HE AGREED TO $400 MORE IN CHILD SUPPORT THAN THE STATE REQUIRED...
ANYWAY...HE ALSO TOLD MY LAWYER THAT I COULF HAVE BOTH CHILDREN WHEN FILING MY TAXES. SO MY LAWYER MADE THE NECESSARY CHANGES TO THAT AS WELL AND WHEN WE SIGNED, I HAD LEGAL RIGHTS TO BOTH CHILDREN FOR  TAX PURPOSES. 

ANYWAY, I GUESS NOT THE X HAS DECIDED MAYBE WE SHOULD 'FILE TOGETHER' BECAUSE IT IS GOING TO HURT HIM....LOL....

I AM LIKE..."HUMMM....WELP, NOPE......" THEN HE TRIES THE "WELL, I MEAN I DID PAY ALL OF THE INTEREST ON THE HOUSE PAYMENTS....SO MAYBE I SHOULD GET TO CLAIM THAT"...

HUM...WELL, LET'S SEE...YOU WANTED TO ABANDON YOUR FAMILY. YOU WANTED TO MOVE ON WITH YOUR LIFE AND LEAVE THE MEMORIES OF THE HOUSE WITH ME....AND I, WELL, RIGHT NOW I CANT AFFORD ANYTHING ELSE AND DONT REALLY FEEL LIKE MOVING TO AN APPT OR SOMETHING.....SO WELL, OBVIOUSLY, HE LEFT THE HOUSE TO ME IN THE DIVORCE TOO.... SO, I AM LIKE "HELL, NO I AINT GONNA SHARE THE INTEREST WITH YOU.....

AND HE THINKS WE WILL MAKE MORE TAX MONEY IF WE FILE TOGETHER, BUT I THINK OTHERWISE. I MEAN ALTOGETHER WITH MY 2 JOBS, AND 3 MONTHS OF CHILD SUPPORT PAYMENTS, AND THE FACT THAT I DIDN'T WORK ALL SUMMER TO BE HOME WITH THE KIDS (WHEN WE WERE TOGETHER...) DOESNT REALLY END UP WITH ME MAKING ALOT OF $$ (LIKE 10,000 OR UNDER.....) 
SO WHAT IS YOUR ADVISE...SHOULD I FILE SINGLE AND GET BACK MY OWN RETURN.....KNOWING THAT IT WILL PISS OFF THE X AND MIGHT FACE THE RAP OF HIM FIGHTING NOT TO PAY HIS CHILD SUPPORT.....
OR SHOULD I FILE WITH HIM (OR CAN I EVEN DO THAT SINCE WE ARE LEGALLY DIVORCED???)
PLEASE HELP......

Feb. 1, 2008 at 2:33 PM you may have to file together since the divorce was so late in the year. i think you should find some tax help and fill them in on this.

Feb. 1, 2008 at 4:57 PM I dont think that he can file for the kids he needs to have the kids 6mths out of the year or something about that. Call your lawyer and ask be safe

Feb. 1, 2008 at 9:15 PM Hey Angela tell him to kiss your ass!!!  I would check with Daniel about it all or your tax person.....maybe you can file married but separated or something like that. I don't know!!  Don't do anything to help him out though.  That's for sure.  You might get more back being a single parent with two kids.

WHELP! I WENT AND GOT MY TAXES DONE THIS MORNING. I AM GETTING BACK OVER $4000!!! YEAH!!!!!

HE IS GONNA BE SO PISSED, BUT THE ACOUNTANT SAID HOWEVER OUR MARRIAGE STATUS WAS AS OF 12-31-07 IS THE WAY WE HAVE TO FILE....LOL.....

I know I'm chiming in on this rather late but since I saw the post about since your divorce being so late that you would have to file together i felt the need to respond....your account was absolutely correct, it does not matter how late you get a divorce in the year, as long as by the 31st of Dec. it's finalized OR if you and your spouse did not live together for the last six months of the year and you have the dependents living with you and paid their cost of support you can also be considered unmarried for tax purposes and your filing status would be head of household, you husband would have had to file married filing separately though. (I worked for H&R Block for a little while before I got sick so I love this topic). I'm happy you did the right thing and getting that big chunk back....Take care
