k to make a long story short. my hubby's ex-bitch of a wife put him in 100,00 debt. while he was overseas she went to the bank and got a loan in his name for 12,000 to buy a car. well, she never paid and it was repo along with the house.she was spending all the money on drugs and other guys behind his back, needless to say that and her cheating on him was the reason for the divorce. well he got thrown into jail because the bank is suing him, i had to go bail him out 1,200. then we went to court, and talked to the lawyer he said he doesn't care if she put the loan in his name without his permission that their going after him cause his name is on it. i'm so pissed off, i want to break both her legs. i'm pissed off at the bank, i think that you shouldn't be-able to get a loan in your s/o name without them being there to sign the legal papers. now. we got a letter today from that lawyer saying we have 10 days to call and pay or their gonna put another bench warrant out for him. his ex has only been out of jail for a year. she went to jail the last time cause she got caught trying to get another car in my hubby's name. my question is can i sue the bank for the giving a loan in my hubby's name to his ex without him being there and approving it. can i sue the lawyer for wrongful judgement,and for being and ass lol. can i throw his ex wife in jail for fraud, she still getting credit cards in his name. we have to file bankruptcy. i really don't want to sue them, i rather them drop the case and go after her. but if suing them will open their eyes, so be it. the Justice system sucks, well at least in sevier county. any body can get something in your name and the lawyers and judges here don't care. they rather just go after the person that name is on it, even if you explained your case to them. i'm so stressed out i don't want my hubby to go to jail again especial because of his ex-bitch. we have a two month old now to worry about. what should i do. i'm freaking out. help PLEASE

Well, Ill be honest with you because I work in the credit biz...

I find it strange that she was able to pull these stunts, especially since after 9-11 idenity and credit instances have really been scrutinized... doing these things now, she can get in some serious trouble, especially if they ae divorced... however, if the divorce is NOT final yet... it all makes sense... generally with people who serve our country, their spouses can use a power of attorney, which basically allows them to take credit, get cars, loans... etc in their names.

It wouldnt help going after the compnies that issued the credit as they, under good faith, issued credit, etc. It would be best to go after her for using his information fradudently... its going to be a long process to prove everything, but as long as you have a specific timeline of the events, your will win in court...

 

-all this is my opinion of course, but I also see stuff like this all the time...
