    For some reason the last part of the question wasn't put on. It was suppose to be finished as murder or assault?

    If it leads to the baby dieing then its murder, just as abortion is murder

    Legally, only a mother has the right to terminate her pregnancy- that's defined as abortion. If someone injures a woman knowing they are pregnant, they can be charged with assaulting the fetus in a court of law. Same with murder. If the fetus is injured/murdered, and the assailant did not know there was a pregnancy, they can't be charged.

    Also, abortion is not legal because "it's not a baby," it's legal because the courts decided that the state doesn't have the right to interfere with a woman's body. Not defending either view, just stating what the laws are about.

    It would an assault towards the mother, which unfortunately ends with the mother losing the fetus.

    My personal beliefs are that abortion should not be legal after the age of viability (lets say 20 weeks) and an assault that lead to the death of the unborn child after 20 weeks should be considered Murder.

    Some states have feticide laws...murder of the fetus. It is always going to carry a hefty penalty regardless. Abortion is not feticide because the mother can legally choose what to do with her unborn child.
